Embryos and Fetuses Will Now Have Legal Rights as a Person Independent of the Mother
 
The Senate just passed The Unborn Victims of Violence Act. President Bush says he will sign it into law.

This would be the first time in federal law that an embryo or fetus is recognized as a separate and distinct person under the law, separate from the woman.

Abortion rights lawmakers contend that giving a fetus, from the point of conception, the same legal rights as its mother sets a precedent that could be used in future legal challenges to abortion rights.

The bill states that an assailant who attacks a pregnant woman while committing a violent federal crime can be prosecuted for separate offenses against both the woman and her unborn child. The legislation defines an "unborn child" as a child in utero, which it says "means a member of the species homo sapiens, at any stage of development, who is carried in the womb."

Edit: I don't have a problem with the fetus being treated as a human.....it's the consequences that may arise regarding abortion that worries me.

So under this law, if a woman wants an abortion and her husband/boyfriend disagrees and she goes ahead with it:

1) Can she be accused of murder?
2) Is it her choice to keep it or to abort it?


Do the laws change if the baby will be born with a disease/handicap & the husband/boyfriend opposes the abortion?

They put a clause Excluding legal abortion. It was primarily designed for violence cases where a criminal kills or injures a pregnant woman, like in the Laci Peterson case. However pro choice groups say this is the next step to eventually overturning Roe v. Wade and making an abortion a crime.

Things that can happen now, you have a fender bender with a pregnant woman. She gets so upset from the accident she loses the baby (Baby lose is very high in the first trimester). You are now on trial for man slaughter. You trip into a pregnant woman at the mall she falls loses the baby . You are on trial for man slaughter. You have a model at shoot you use toys on her ,she doesnt know she is pregnant . She loses the baby ,you are on trial for manslaughter. We are also not taking 7 months in big stomach ,this counts four weeks in. This is dangerious shit.

imagine a mugger comes up tries to grab your purse which you've got strapped on defensively, and you're inadvertently knocked to the ground landing stomach first, the mugger panics and flees but is later caught.

Imagine as a result of landing on your stomach, you end up having a miscarriage, losing the child you fully intended bringing into this world.

What would you want the mugger charged with?

give me a freaking break.. Bush has ran on the promise of making abortions Illegal. You don't think this is a first step? You can sit there and tell me this won't be the first thing that happens as soon as this bill is passed into law? How hard do you think it will be to use this law as a way to stop abortions.

I give it less than 6 months for the 1st case to hit the court rooms but I'm sure it will be sooner. After all if the law states that a embryo is a living person with rights, it would be hard to abort it with out saying it's murder now wouldn't.

Do some research OR watch some new....

I don't watch much TV myself - but I do try to keep up with what is going on. There are several ways to get news. I am not aware however of any degrees being offered in watching TV - must be somethere you have where you live.
