FOCUS ADULT Ripped me off
 

This is Mikey, many of you will remember me from Phoenix Content, which I left in November 2002. Then the company became FOCUS ADULT.

I had a verbal agreement with Craig Keddie, President of FOCUS ADULT, which he has RENIGED upon without any explanation. I only received a single email stating that the agreement will no longer be upheld.

I ask those of you who know me, who have done business with me, and whom I consider friends, and all adult webmasters who care about honest business to BOYCOTT focus adult until such a time as Craig is willing to talk to me and honor the agreement made when I left.

I encourage you to write to [email protected] and ask him to give me the courtesy of an explanation as to why he is reniging on the agreement he made with me, and to state your unwillingness to do business with FOCUS ADULT until he rectifies this current clusterfuck.

Since he has reniged on our agreement, this is a very important issue for anyone who has made purchases after November 2002, as the validity of your license is questionable since Craig has not fulfilled his buyout to me.

I regret to bring this issue public, but Craig will not answer my calls, will not return my emails, and will not speak to me online.

I just called him and he hung up on me ....

Sad. Immature content providers bringing their partnership disputes into the forums and threatening webmasters that they don't have a valid license anymore.

I dont think any webmaster wants to be kept out of the loop of any invalid content,because when/if the shit hits the fan the webmasters are the ones who will be hurt in the end but I do agree that the threat is wrong

I dont mean it as a threat to webmasters, EbonyFelony, anyone who dealt with me at phoenixcontent knows that i loved all of my customers, and am still friends with many of them. I am simply trying to FIX this situation, because CRAIG REFUSES TO TALK TO ME ....

I never had a problem with Mikey he always took good care of me. The relationship we built turned blossomed quite nice over the years and his content made me some good cash too.

Very few content providers would bend over backwards like he did for his clients. :thumbsup

Yeah this seems the new trend now, the content providers screw each others and they want all the customer to take part on it, this happened me with sobe and was enought, if you don't want other guy playing with your content, don't sell it to resellers and sell it yourself, you guys can't keep fucking the buyers with your problems not related to us.

This remembers me when the main dialer doesn't pay and all the resellers tell to his webmasters that they won't get the money as he has not been paid, the webmasters are your customers, you sell or resell them a product, they don't need to care about your main provider, thast exactly why you get a comission as guy in the middle, i laught at guys who only want to be resellers for the
profit, but not for the risk involved.

SpermbergMikey don't take this personal, this is not specially against you or focusadult, as i don't know who is right on this, but also we don't care if he payed you or not your part of the company, it's a problem betwen you both, don't fuck the customers. It's even ok if you make it public to make him appear, but not to start talk shit about license issues or webmasters contacting you, etc.

Let me sum it up for you. Craig and I had an agreement, he has decided not to fulfill it or talk to me, he hangs up on me, will not talk to me.

This can all be simply resolved with a discussion between craig and I, which is all i am trying to achieve.

The fact of the matter is that i have not been fully compensated as agreed when i left, and that means i still own a percentage of the company. All of this can be solved very easily by Craig. I have expressed my willingness to be reasonable with him, he WILL NOT SPEAK TO ME!

Oh well - TWO more people to keep clear of in this business. How on earth you expected the posts or statements to get you much in the way of sympathy is beyond me. Telling people that because you have no business sense their licenses 'may' be invalid really doesn't help you cause. It could be that you are 100% in the right but to threaten not just the guy who fucked you over but anyone who actually uses your (?) stuff because YOU have problems really isn't the way to go about things.

I agree completely it is between he and I, but i dont know what else to do. I have called him 100 times, he hangs up. He refuses to talk to me and settle the situation.

As i said, any webmaster that has dealt with me in the past knows that i am honest and i care about them ... im sorry to bring up the licensing issue, but honestly, if he has reneged on buying me out, then what does that mean? and what am i supposed to do if he refuses to talk to me?

I know Mikey very well and we still continue to work together today. The split in his partnership with Craig was something that became unavoidable but Mikey did not feel that the situation was a public matter.

The end of Phoenix Content was not ugly because all parties involved came to certain terms of understanding and an agreement for a buyout was reached.

Mikey always did what he could to make things right with his customers because he sees customers as business partners, not just another sale. His post here comes after 2 months of frustration trying to regain what is rightfully his. Do i agree with him questioning the validity of content licenses? No. Certainly there is a better way to rally the troops.

I have always supported Mikey 100% and will continue to do so. If I was out $50k, I would be looking for answers too.

Craig honored the agreement 100% until june 1st 2003, when he sent me this email:

Mike,

There will be no further content of any kind added to your account or funds.

There is nothing more to discuss with you now or at any time in the future through e-mail, my employees, telephone, in person or any other medium you may chose on these or any other subjects.

Im not looking for sympathy, i just want Craig to stop ignoring me and act like a man. Im SINCERELY sorry if I went about this the wrong way - but Craig can solve all of this with a simple conversation with me.

Obviously most of you have no clue who Mike is and just feel like ragging on him, which is the norm here for folks who rather talk shit than do business anyway. I have bought content from Mikey a very long time ago for years it seems, most likely longer than some of you have even been in this industry ;) , he was always very helpful and quick with helping me with anything, one of the absolute first person i went through for a deal for content such as: pay 200 a month and get 30 sets etc Mike/Phoenix and Focus Adult do and have always kicked ass when it comes to content and being professional.

I wont let years of dealing with someone get pushed to the side because he sounds like he is being fucked out of what he claims 50k. Let him make his post like the rest of the people who try to collect and get fucked by companies, fuck taking sides let it take its course.

Mikey always was cool and helped out let him try and get what he deserves, who cares really if its right or wrong, its not really any of our place to justify anything, he clearly doesnt work for them anylonger and is o9nly trying to gain what he lost.

Alot of people, myself included, only purchased content from focus adult because Mikey's old site redirected there.
We wanted to do business with Mikey and were told that all of his content was now for sale by focus adult, so we bought it there.

If he's not getting his share of the deal then that's definitely not fair.
HIS name brought THAT company a lot of business.

Normally I cannot stand people who air their dirty laundry on public boards. However, I have known Mikey for a long time. I met him when we started purchasing content from Phoenix Content, and the arrangement we have in place continues on with Focus Adult.

Mikey never told me the exact details, which is professional since it's really none of my business. However, after a long period of time with no results it seems Mikey has decided to go public with this. There seems to be a fairly large sum of money involved.

Maybe it's time for me to seriously reconsider the contract I have in place with Focus Adult.

Thanks for your support ... up until june everything was fine, and I was actively still referring people to Craig/FocusAdult. but he just out of the blue stopped sending me $ and content (i will avoid getting into specific details of the agreement)

I would have told you in may that Craig is reputable, respectable, and honest. I dont know what the hell is going on, because he simply will not talk to me. He just sent me an email, i think i posted it above.

All i want is to resolve this with him.

If you want, simply send craig an email and tell him to settle the agreement with me - and everything will be fine. encouraging craig to talk to me is the best thing to do to resolve this clusterfuck.

In my dealings with Mikey he's always been a standup guy. I hope this thing can get resolved one way or the other, and I must say that I'm a bit nervous at the idea of my licences suddenly being potentially invalid.

Mikey is a great guy and was able to pull through for us back in the Phoenix Content days. I don't think he would have resorted to airing this in public if he didn't feel it necessary. 2 concerns of mine:


1) Mikey, I have to ask: Why in the heck didn't you have a written contract? Verbal contracts, although binding, are rediculously hard to enforce unless you have something to back them up.

You're in the license business and you went with a verbal contract??!!

2) This thread will die soon, and the total loss of business to Focus Adult will be minimal. For that reason, you need to hire an attorney ASAP. They're expensive, I know...but you might be able to find one either pro bono or on commission. Regardless, you know the old saying about squeezing blood from a rock....if Focus Adult doesn't have the money, it will be rather tough for him to pay you.

I completely trusted that Craig would honor the agreement, and he did from November 2002 through May 2003. I did not feel the need for a formal contract although i do have details of the agreement we made saved from online conversations. Im not getting a lawyer, im not necessarily after the money ... part of me just wants the courtesy of an explanation, and a little respect, instead of ignored emails, being hung up on when i call, etc... Im not trying to cause a loss to FocusAdult, im simply trying to get Craig to talk to me. I was going to bring this public a week ago, but i cooled off and was busy. then when i called him this morning, i said "its mikey" and click, he hung up ... that did it.

Craig, ive told you im willing to renegotiate. Stop being childish and message me, and we will come to a complete agreement, i will sign a document stating that you own full licensing rights, and this will all be over.
