We are going ahead with legal action agianst WSB.
 
We are going ahead with legal action agianst WSB. We recieved our January check today and like many of you it is short, we are missing $1026. That was the last straw.

The reason for this post is, like myself, many of you have also been short changed for pay periods Jan1 to 31st. Im sure some of you called WSB regarding this issue. I would like you to PLEASE post the excuses you've gotten this time. We were told it was a type "o".

Also, I would like to mention that my team believes that the reason the checks are short was not in error but in dilberate deception. Allow me to explain, lets assume they are once again trying to fuck us, if you cash your checks you ACCEPT payment for that particular pay period. Again I repeat, this is just speculation on our part, NOT a fact. Please use your own judgement on this particular issue.

This is my last post on this WSB matter utill it has made its way out of court.

Interesting. It almost seems like 3rd party processing for adult sites isnt a viable business plan any more. Then companies are forced into these kinda tactics if they want to keep any market share.

well, not all of them at least... ccBill *always* sends our checks on time, we don't worry about these kind of problems w/ them, they've always been on the level for us (for 3 years now, at least!)..

My #1 sponsor doesn't use third party billing.

BUT, you have to REALLY trust your sponsor.

When Ibill tried to say they couldn't pay people for the web900 billing because Worldcom (or whoever it was) went bankrupt and didn't pay them, no one wanted to hear it. Everyone said the agreement was with Ibill so it didn't matter.

This is no different.

No, it shouldn't matter. But it would still be interesting to know.

I would think if the sponsors were not paid their cut, they would be causing just as much of a fuss. So I'm making the assumption that they have been paid, yet the affiliates have not.

Just some thoughts, and assumptions.

from what i understand you probably shouldn't cash it, someone intimated here on the boards that doing so can constitute your acceptance of settling for that amount, not sure if thats correct or not..!

wsb sent the cheques directly to the affiliate. worldcom didn't send cheques directly to affiliates.

this is an interesting - BAD - legal situation.

doesn't it come down to how the contract between the parties is written?

in some fields like construction, for example, standard contracts contain a 'pay when paid' clause. ie you don't get paid for your work until the guy ahead of you in the chain gets paid. but i don't think i've even seen a contract like that outside of construction.

what is the case here?

I don't know actually. ;) The contracts could be written differently in which case the sponsor may be free and clear legally.

I wouldn't care anyways. If I sign up with a sponsor promising me 50% of sales, I don't care if the processor they are using is having checks withheld from them by their banks because one of their bigger clients screwed things up for them. Get a processor that doesn't live week to week.

If the processor doesn't pay, the sponsor should pay out of their own pocket.

Since WSB is still operational, Im sure Triple X (like I sadi) is doing there best to resolve this.

IF WSB would be go bankrupt Im sure Triple X would take care of the payments, without hesitation. For the time being thats not the case.

when you signed up you were getting paid by wsb. if they don't pay, you go after wsb.
