A 19-year-old woman accidentally shot dead her brother while posing with a gun for Facebook photos on New Year's Eve.

Manuel Ortiz died instantly after being shot in the head at about 6am on Monday morning.

Family and friends wept as his body was carried from his apartment in Phoenix, Arizona, where the shooting took place.

Police said 22-year-old Ortiz and his sister Savannah Ramirez arrived back at the home they shared on New Year?s Eve after spending the night drinking.

They were with two other people when someone in the group pulled out the handgun to take photos with it.

As the 19-year-old posed and played around with the weapon it went off striking Ortiz in the head, according to ABC15.

He was pronounced dead at the scene.

It is not known if the group knew the handgun was loaded.

Yes, and that's the way I treat firearms as well. I don't care if it's empty... if I ever see a barrel pointed at me, during cleaning or whatever... that will probably be the last time I'm around that person. So many people are way too nonchalant with handling these things, and seem to have no clue what they can do to someone.

Check out this video at the 4:50 mark. These military guys appear to be completely clueless with the handling of that rifle.

Those butt heads did everything wrong.
1. Played with a gun
2. Obviously didn't know what they were doing
3. Didn't check to see if it was loaded
4. Pulled the trigger on the damn pistol

As someone who has been around guns, one of the worst things I hate is someone who can't keep their finger out of the trigger guard when handling a gun.

My brother was bad with that rule. He was showing his Glock .40 off to a group of people and it was bad enough there was a clip in the gun. Even worse that there was a round chambered and the safety was off. There was a girl who's never seen a gun her entire life, but thought it would be cool if she she held it. While he was about to hand it over, the gun went off and just missed another person's feet.

1. Always assume a gun is loaded

2. Do not point a gun at anything or anyone that you are not prepared to kill.

They haven't concluded who owned it yet. There are classes that you have to take and pass along with a waiting period. This only applies to people who obey the law. For all we know, this gun was illegal, at which point those regulations are meaningless.

if this gun was legal, this death is the responsibility of the gun owner that was there, not the sister, it doesn't matter how stupid she might be, scratch that, it absolutely matters how stupid she might be. The friend who legally owned the gun should have been a lot smarter then to hand it over to his friends, loaded, with safety off. If they were at a range that's one thing, but he handed them his gun so they could take pics of themselves pointing it at their own heads? that's ridiculous.

to me, this is negligence causing death, another issue with guns,

for how much shit we take as an industry, and how much I really dislike guns, I am pretty impressed with how responsible many of the gun owners on this forum appear to be.
