Prostitution vs. Pornography
 
I've been shooting photos of hookers for over 10 years now. I've always figured if caught I'd just chalk it up as a loss and keep it moving. Actually been trying to transition from dealing with crackheads for 5 years now, but I have a following with quite a few loyal customers. It's guaranteed money, so why stop. Besides, it's my own personal fetish. It isn't really even about the money to me at this point. I make enough to live on and get my thrills travelling. Most importantly, I just enjoy what I do.

I got busted last week while shooting a girl I've shot photos of many times before. The officers had a good time looking at all the footage on my cameras. Especially the tranny scenes. Thought they'd just give them back to me with a ticket and let me go. Nope, they confiscated my cameras and refuse to return them to me until I pay for the release of my car from impound. The cameras and car where confiscated separately. So, I contacted an attorney and he says because I was shooting porn, they violated my 1st ammendment rights. I'm not looking for legal advice here. I'm just wondering if anyone thinks the lawyer is just trying to get a quick grand from me. Is it even possible to win? At this point I'm trying to decide to fight or just pay the impound lot $900 bucks and move on. It's an old car, I've got others so transportation isn't an issue.

What does the fact that they are hookers have to do with anything? Is there any contracts signed? Cops try to figure out any way to steal peoples shit, I would much rather spend a grand on a lawyer than to give it to them.

Undercover officers were patrolling an area while I was shooting stills and video of a chick stripping for one of my websites. She happens to be a prostitute with a lengthy record. No shit. That's what I was thinking. But this lawyer has me wondering. Is it really public if no one else was there to see. We were in a highly secluded area. He says at the least, they'll just give me my shit back, but it'll take a few months.

Been there, done that. It was still a public location. IMHO, your lawyer has a somewhat valid point about the 1st Amendment but the fact that you were in a public area opens you up to a lot worse situation. Fight this and you will lose money and gain the kind of attention you should be avoiding. Look at the long term picture here and walk way.

Indeed. If it were in private and they held your stuff as evidence for a possible prostitution case that never materialized, there might be something to fight.

Here, you have a ticket for public lewdness because you were in fact engaging in public lewdness. I don't see any first amendment case here.

If noone could see, if it wasn't a public place, the cops wouldn't have seen and you wouldn't have been busted. The fact that you got caught by a cop passing by pretty much proves that passerby could tell what you were up to doesn't it?

Yeah, trust me. I cooperated fully with the officers when they rolled up. I felt I was in the wrong, BUT they pissed me off by takiing my cameras. I can't get anything back until the paperwork is done. It's been 2 business days. Maybe tomorrow. That's the only reason I talked with an attorney.

I am sure it depends on what jurisdiction you are in regardless it will be much less of a headache to just pay them off.

They can make a lot more trouble for you then you can make for them.

Yeah, I thought about that too. But they have it set up where when you claim your vehicle, it's essentially a "settlement." The paperwork says exactly that. They don't pursue any further charges. I'm done with filming on the streets now.

Yeah, it's ironic that I never have a problem in L.A. or Miami. But in my hometown of Detroit it seems to be a problem. Trannies that I had left on my camera are all from Detroit
