H.Obama Takes It In The Ass!: Court Rules Mandate UNFUCKINGCONSTITUTIONAL!

Appeals court rules against Obama healthcare law 1:48pm EDT WASHINGTON (Reuters) - An appeals court ruled Friday that President Barack Obama's healthcare law requiring Americans to buy healthcare insurance or face a penalty was unconstitutional, a blow to the White House. The Appeals Court for the 11th Circuit, based in Atlanta, found that Congress exceeded its authority by requiring Americans to buy coverage, but also ruled that the rest of the wide-ranging law could remain in effect. The legality of the so-called individual mandate, a cornerstone of the 2010 healthcare law, is widely expected to be decided by the Supreme Court. The Obama administration has defended the provision as constitutional. The case stems from a challenge by 26 U.S. states which had argued the individual mandate, set to go into effect in 2014, was unconstitutional because Congress could not force Americans to buy health insurance or face the prospect of a penalty. "This economic mandate represents a wholly novel and potentially unbounded assertion of congressional authority: the ability to compel Americans to purchase an expensive health insurance product they have elected not to buy, and to make them re-purchase that insurance product every month for their entire lives," a divided three-judge panel said. Obama and his administration had pressed for the law to help halt the steep increases in healthcare costs and expand insurance coverage to the more than 30 million Americans who are without it. It argued that the requirement was legal under the Commerce Clause of the Constitution. One of the three judges of the appeals court panel, Stanley Marcus, agreed with the administration in dissenting from the majority opinion. The majority "has ignored the undeniable fact that Congress' commerce power has grown exponentially over the past two centuries and is now generally accepted as having afforded Congress the authority to create rules regulating large areas of our national economy," Marcus wrote. Many other provisions of the healthcare law are already being implemented. The decision contrasts with one by the U.S. Appeals Court for the 6th Circuit, based in Cincinnati, which had upheld the individual mandate as constitutional. That case has already been appealed to the Supreme Court. The Court of Appeals for the 4th Circuit, based in Richmond, has yet to rule on a separate challenge by the state of Virginia. Wow, I didn't realize that people still saw a correlation between required auto insurance and required health insurance... aside from them both containing the words "required" and "insurance."
|
I hope the whole Obamacare plan totally unravels and falls through, and I hope the insurance companies gain FULL control over your lives again, and raise rates through the roof every 6 months.
I hope the loudest Obama-hating assholes are the first to get diseases and conditions that are not covered by the for-profit insurance companies, and they fucking die in pain! Also, I hope the anti-Obamacare folks die in line at the ER, waiting behind the uninsured. That's what I hope. Welcome to Stupidville, USA - population: assholes. |

yeah I want what Obama is smoking.
Fining people for not buying health insurance is the stupidest thing ever. And just who is going to fill those JOBS??? The government is going to have to send out fines to people across the nation... and what happens when they don't pay THOSE fines??? Are we going to put them in JAIL? More government expenses. It's fucking stupid and they need to get off blue cross's dick. |
Your title has a typo.

The H.Obama "Health care" plan REQUIRES you to BUY health insurance FROM A FUCKING INSURANCE COMPANY OR BE FINED AND CRIMINALLY PROSECUTED! Dumbass! How do you remember to fucking BREATHE? Moron! http://i484.photobucket.com/albums/r...die/morons.jpg |

Fathom the odd hypocrisy that Obama wants every citizen to prove they are insured, but people don’t have to prove they are citizens.

Hey sally, you nasty old slut, how's the spam biz?

Ummm... auto insurance isn't required if you don't drive a car ... driving on public roads is not a right, it's a privilege. You can drive all you want on private property with no insurance that's your right.
Being alive is an unalienable right... |

Do people have to pay for mandatory vaccinations for their children?
If they don't pay, do they get penalized by the school not admitting the child? I don't know, just asking. |

Met what requirement? Whining, I quoted someone? I think you're meds need checking! two things in the statement, first ( "Obama wants everyone to prove they have insurance" What part of this is wrong, or something that he met before he was elected? Second("but people don?t have to prove they are citizens." This is evident of the court battle placed on Arizona's law. So please enlighten us as to your logic, or please then if you have no avenue but insults, fade away! Because at the present time, your argument is likened to that of pedestrian waiting for the color of a stop sign to change |

if you have insurance, who gives a shit if its mandatory... . |
Quote:
You can argue that "driving is not mandatory" although I don't personally know anyone who doesn't have a driver's license. But still... |
Quote:
Everywhere I have lived required you to have a license plate on any car on your property. If not it was considered "junked" and to be towed away. So to get a tag...guess what you have to buy: Auto Insurance :( Not saying that anybody would really WANT to have a car that they only drove around their yard...but just saying that the govt. always finds a way to fuck you over and hold hands with the insurance company in both health AND auto. |

I complain about privacy invasion as well, yet I'm not doing anything illegal. The common argument is "you shouldn't care as long as you aren't doing anything illegal." |

I'm just playing the debate and I don't see how it is unconstitutional when there are other fees we are required to pay. What would be unconstitutional about a government requiring people to pay a health care premium in the income tax? They require Social Security, Medicare and Unemployment Insurance deductions already. What's the difference? http://ssa.gov/pubs/10003.html How the fuck do we get mandatorily taxed for Medicare but somehow that's not mandatory payment for healthcare. :1orglaugh But since people can be unemployed and the purpose was to make sure the unemployed were insured; the plan couldn't work thru a payroll tax. Also, mandatory buying insurance is the only way to get this program without raising taxes. If Obama raises taxes for HC insurance then he's called a "socialist". |
Quote:
the healthcare bill should be thrown out.. the only good that came out of it was forcing insurance companies to take people with pre existing conditions... this country needs affordable healthcare for low income people and families and thats a fact.. how we get there is always going to be fought about... . |

let's face it, this wasn't healthcare reform anyway, it was health insurance reform.
the problems that plague healthcare have yet to be addressed. |
So wouldn't this mean that being required to by auto insurance is also unconstitutional?
