Jman 05-25-2011 02:11 PM

DAYUM Tucker long time no post ;)

tucker 05-25-2011 02:19 PM

Hey Jman my long lost Soccer partner. I mostly lurk these days. Be nice to catch up in person if I make it up to you or if they let you back into the US ;-)

strobi 05-25-2011 02:21 PM

"Private is seeking to learn XHamster's actual owner's identity. XBIZ was unable to reach the operator."

Doesn't look all that concrete to me, but still, nice one!

Robbie 05-25-2011 02:22 PM

Go get 'em guys!

You are looking through confused glasses, so please let me clean them for you...
It is procedure. Privacy service gives up information, complaint is changed to name that party and it continues. Simple.

MaDalton 05-25-2011 02:25 PM

interesting...

Wouldn't it be hilarious if it was someone like Dick Chaney or Newt Gingrich.

In the past year, Private aggressively has gone after alleged infringing sites, most of them tube sites, including YouJizz.com, SkimTube.com, EskimoTube.com and Tjoob.com, as well as XonDemand, EmpFlix.com and TnAFlix.com. All of the suits are pending.

Kudos and good luck to Tucker and Private! :thumbsup

I am enjoyed Middle Men... I had mixed emotions but a few good laughs as I was putting who to who. Overall Loved it! An early Clay, I thought was captured perfectly.

jigg 05-25-2011 02:41 PM

I have a feeling Xhamster and its owners are somewhere where US courts can't reach - think Estonia, Ukraine, Russia

Here's another one for you all...

The suit names Westchester, Calif.-based WhoIsGuard, which protects online identities through its service, as the defendant, as well as 100 John Doe companies and another 100 John Does.

The "John Does" Companies. Why weren't they named by name? Wouldn't it be obvious who they were?

i think if you know the players and the real story, what chris did was a big slap in the face to joel and clay..

luckily, it (the movie) was a major failure so the egg is actually on his (mallick) face... :2 cents:

Owner is from E. Europe. I think Ukraine. Waste of time IMHO. Instead, they should go after traffic brokers that sell space on that site.

That's why they file against Doe's, which are treated as placeholders. Upon discovery they simply substitute their names. They don't need to refile with the court and start over.

With 100 Doe's as individuals and 100 Doe's as corporate entities that's a lot of advertisers, ISPs, CEOs, CFOs, CTOs, and other individual stakeholders. Even if the actual owners are non-suable, the case against the Doe's can continue.

Chris 05-25-2011 04:46 PM

Tucker - when you guys find out who owns xhamster will you guys release that info to the public?

Also if they are in a country outside of your reach ...what will be your next step?

Regards,
Chris

Rochard 05-25-2011 04:56 PM

Tucker? LOL. Jason Tucker came up in a skype conversation this morning. The irony slays me.

All information becomes public record unless something else is worked out. From what I have seen, there is no country that really puts a URL/Site out of US reach.

Richard - Glad I could amuse you O L D friend. LOL.

jigg 05-25-2011 08:13 PM

i get the feeling someone will burn a lot of cash for nothing if these guys are in the RU or Ukraine. Considering how much of the mafia there has been moving from shipping prostitutes to Europe to online porn this could end up being just a mosquito bite for them

Rangermoore 05-25-2011 08:27 PM

IMO... Waste of time and money.. The genie is out of the bottle and ya can't put it back in.. Tubes are here to stay..

There isn't any "Does" . He has Ukrainian ISP, traffic brokers that sell his services on THIS forum.
Get you shit straight dreamer. So they win default judgment because he doesn't show up in court. What do you think is going to happen?

Phoenix 05-25-2011 09:47 PM

contrary to popular belief there is no safe place for anyone anymore
that comes from a lawyer at one very big ass law firm

96ukssob 05-25-2011 10:08 PM

Great, take them down one by one!

tiger 05-25-2011 11:54 PM

Private seems to have found a formula to systematically go after the tubes.

BTW just cause the guy may or may not be in the US doesn't mean you don't want to defend yourself against a default judgement. I bet there is some way to use that against the owner in terms of domain ownership or hosting.

If you facilitate the ongoing operations of an illegal business cant you get done aswell?
If he's issued with a take down notice and doesn't comply, what time period does he have to reply by? If no reply go after the host or the sponsor.

the fear of a costly legal bill should cut off the add brokers pretty quick nope?
