Can you be sued for slander for leaving negative ebay feedback?

Dear robfantasy,

Sir. I am really upset that you left such a nasty feedback. Do you know what Slander means? Slander: Law. Oral communication of false statements injurious to a person's reputation. A false and malicious statement or report about someone. You have done severe damage with your Scam alert feedback message. I know that you clearly did not read the instructions for payment and shipment. All the notice of fees were clearly stated on my listing. I feel that I must contact my lawyer to see about what can be done with this situation. Just wanted to let you know. Thank you.

some of the people over 60 that are ebay users are some of the most impossible people to deal with.

nothing is worst than old customers, but old customers online, is live dying slow each second of correspondence.

Global Dialers 07-28-2004 09:51 PM

you can be sued by anyone for anything

whether they win or you can afford it is a different matter :thumbsup

robfantasy 07-28-2004 09:52 PM

psyko514 07-28-2004 09:52 PM

Was there some hidden fee or something you didn't want to pay?

fr8 07-28-2004 09:54 PM

I would say no. Probly just some soccer mom getting pissed.

robfantasy 07-28-2004 09:55 PM

He probably didn't want to pay the $25 shipping fee that some of those eBay fucks have decided to inflat to pad their earnings. eBay should have some sort of regulation for that shit too.

when the auction was over she said it was $30 w/ shipping

how the fuck did it go from .01 to $30, i was expecting to pay like $10 total.

i told her look misunderstanding, lemme pay u for your listing fee and we just wont leave each other feedback. ... but after a week she decided to give me negative feedback, so i let loose on her ass.

Looks like she's charging you $25 shipping plus the $5 handling.

I would have emailed her back and just asked her why shipping is so expensive...

What a bunch of bullshit! I really don't blame you for getting royally pissed off. I say fuck that bitch and would tell her to bring it on. :ak47:

You think speakers are going to be cheap to have shipped???
You contact the seller before you bid on the auction if you cant afford the shipping fees.

Apparently you aren't the only person who has left negative feedback for this seller. Someone else threatened to file a fraud complaint. This was an obvious scam. Charging $30.00 shipping for an item that cost $.01 is a fairly clear case.

Ebay DOES have rules about how to list and charge for shipping. There was nothing on her auction stating what shipping charges would be that I saw, only the $5.00 handling fee.

Call bullshit on her and report her to E-bay.

dude, no offence, but what part of "Seller's payment instructions & return policy: Please inquire about shipping costs (...) You pay all shipping costs." didn't you understand?

if you bid without inquiring about the shipping price, you're agreeing to pay all shipping costs. there are no rules on eBay stating she has justify her shipping costs or prove em to you.

personally, if i don't see the shipping cost listed on the auction, i don't bid.

ya, but she didn't say $1000, she said $25...who knows she could have been shipping it with FedEx or UPS which is more expensive.

Absolutely! She sells the speakers for $.01 and then charges a big ass shipping fee to make up for the difference. You said nothing slanderous about her, but did you inquire about the shipping costs beforehand? Were you both in the U.S. or did she ship out of country? Not like that makes any difference, but always beware if the shipping/handling costs aren't stated up front or they don't encourage you to email them beforehand for shipping costs. True E-Bay sellers will let you know beforehand the costs to ship to your location (via e-mail) or it will be stated in the auction.

I'd go after her scamming ass for fraud. And I would also forward the e-mail you received from her onto E-Bay. This sorta sounds like extortion to me....

had you inquired beforehand, you'd have known if she were charging exorbitant shipping amounts and opted not to bid ;)

Total scam.

The guy says:

THERE IS A $5.00 HANDLING FEE/PLUS THE SHIPPING FEE

Which leads you to understand that he will charge you $5 + acutal shipping. So he's trying to say that it costs $24.99 in actual shipping to ship those speakers to you?

Fuck that guy. Tell him to eat a cock.

On that note... I recently bought some stuff on ebay.. a few little low dollar items adding up to about $25. The seller wanted to heavily pad the shipping AND charge me $12 INSURANCE (for $25 worth of merchandise).

People these days are just shameless with their scams.

obviously you are. didn't you say you only gave her a bad feedback because she gave one to you?

BoNgHiTtA 07-28-2004 10:52 PM

Your clearly trying to scam poor julisplace . .01 for these fine quality speakers is an outrage. You should be ashamed for taking advantage of a innocent EBAY power seller like this.

BigFish 07-28-2004 11:00 PM

You can be sued:

and I hope you do. :1orglaugh

Seller's payment instructions & return policy:
Please inquire about shipping costs, we will offer several ways and costs. THERE IS A $5.00 HANDLING FEE/PLUS THE SHIPPING FEE. Will accept paypal or Money order/Cashiers checks and Personal checks US only. Will ship world-wide. You pay all shipping costs. Must pay before shipping. You choose if you want insurance on it! Item will be shipped as soon as payment is received. Thank you!

Pretty fucking vague . . . never seen that before

I just shipped a 3 foot tall My Size Barbie all the way across the country for $12 with insurance by priority mail. Those speakers did not cost $25 to ship.

BigFish 07-28-2004 11:16 PM

who gives a shit if it costs 25 or 100 dollars to ship. the ebay page is a contract and when he clicked on the bid button to bid on the item, he expressly agreed to the contract period. nobody forced him to click on it. he could have, on his free will, inquire about the shipping price before hand, but he negligently chose not to. do you people go around signing contracts first and then asking what certain terms of the agreement means afterwards? the idiot even admits "he was expecting it to be a certain price". he dived into a contract without even knowing the true, final cost. what a fucking genius. he deserves to get hit on the head with a lawsuit. :1orglaugh

Volantt 07-29-2004 12:04 AM

I hate that shit when they sell for .01 and then try to over charge for shipping to make a profit.

Ebay needs to curve this behavior. It just causes more problems, like this.

are u a fucking idiot, if you bury a clause in a real estate deal that says you will pay me 1 million dollars added to the final price, do you think you can hide behind the "you signed the contract defense".

Something that most people seem to forget is that for that statement to be libellous (slander is spoken, libel is written) it has to be untrue. It isn't.
