There should be no legal distinction between a rape scene in a 'R' rated movie and a rape scene in an 'X' rated movie.

When the debate is whether or not to show the penis... um... who cares? Why should one be legal and another illegal? If it's a RAPE scene, it's pretty safe to assume there is a penis present. :glugglug It doesn't make it any worse to see it on screen.

Humans have a lot of primitive aggressive urges. We are animals and our neurology is still guided by instincts; whether violent or sexual or both, those urges need a safe outlet. That is the pro-censorship arguement, but in practice, that is not really how psychology works.
