Is it wrong to steal sombodys site design?

Look at this shit! This guy not only stole my site design, but my exact textlink discriptions too?

Is there anything I can really do about this?

I always send an email telling them that
i've contacted my lawyer etc. etc.

80% of the time they take down the site
immediatly..

It's seemingly more than just a coincidental resemblance. Enough to call it plagiarism (using someone else's ideas). However, can you do anything in html that's so fucking original that you can expect copyright protection? I'm not an attorney, but I doubt it.

He stole the "look and feel" of your site, no doubt about it. How do the courts react to "look and feel" arguments? The answer is to look at all the guitars that look almost exactly like Fender guitars. Fake Stratocasters, fake Telecasters.

Like I said, I'm not an attorney, but that's how I see it. If you want to be sure, ask an attorney.

no adoubt that he has the same layout with yours,only the counters are in different position.Even the same textlinks! That's the amazing part.
I agree with MrCocktale, contact him and tell him that your lawyer will handle the situation if he don't take it down.

I dont think it would've been so bad if not for the fact that he copied EXACTLY your site (with a differnt background color).

I flip through Thumbzilla.com alot to get IDEAS on layouts and how to word things (because i am a newbie), but I would never copy the site and add my pictures to it like that guy did.

So in my opinon for you, OH YEA-thats wrong! LOL

I like your site better and if he has copied it then its the mentality of a loser so don't waste time and energy chasing or worrying about it. Take it as a compliment, I am sure it's not going to have any effect on your sites performace.

It's so much easier to just build your own page? It's harder to go in and swap out code. It takes just as much effort.

It's more than just a design too.

It is what my site has evolved to over the past year. It's a year of trial and error...finding out what works best for me.

I originally started this site as a TGP, it then became a link site, which evolved into a semi content/blind link site, then into a Movie site...then into a script site, then into the layout I have now, part movies, part thumbs, part blind link, part toplist.

This guy will have no effect on my business, but it's the principle involved. It's just very frustrating.

I think the fact that he's not costing you any money says a lot about how you should handle it. "What's the damage?" (in terms of $) is one of the things an attorney would want to know, the other one being are his pockets deep enough to make it worthwhile going after him? If he has to borrow someone's site design wholesale, I doubt if he's sharp enough to make it work for him anyway.

I know how you feel. Am a graphic designer and all thru my career I have come across this kind of thing Lazy people who think it's ok to steal someone else's hard work (design, layout, ideas, graphics, photos, etc). Amazing how often this happens.
I would suggest you follow MrCockTale's advice, the mail with mention of lawyers blah blah, that works most times. Since most are clueless of copyrights and such matters they get scared and take down the site.

When you write him make sure to "cc" all his sponsors so he knows you're not dicking around. Sponsors usually refuse payment to dickheads that can't come up with their own ideas.

There might be a different way to approach this. You could email him/her and suggest that they a) give you a link as homage to you since they found your design to be so superior as to copy it. Imitation is the greatest form of a compliment. B) find out if he/she will signup under you using your codes so that you will get some credit if he/she does well also since they are using your design. Maybe this approach will give you more satisfaction, and end up compensating you

if I would be the sponsor then hell yea! ok lol, but sponsors as Quoth the Raven said care about the green papers ($$). Also, they don't have the legal right not to pay someone for something like that.

i need to fix the colors cause i dont like them a lot. stealcock.com was the domain i register that existed before as dad's hardcore place and I turned it into a softcore site.I'll try to be part of what the last theories saying....more soft more soft blah blah blah,anybody will follow me?

Susan it do have an effect on your site when he haves traffic ... When I put up a new layout, after 2-3 days, theres like 10 sites taking the same links and all ... And I must change my layout each week if I want to keep it productive ... Everyday I see new labels from webmasters who copy / past my site in my ucj admin ... Thats why I need to work on 1 fucking layout per week at least !!! I hate thoses who copy others layout .

I totally agree, take it as a compliment. Maybe in the future he will do it to someone who will retaliate/sue and it wont be so funny. I really feel for you because I know how it feels. I have a little baby to support by myself (the cutest sweetest little person in the world) His dad died in a horrible car accident. I would be very upset if someone caused me to lose money that I need for him to have a good life. Wouldn't it be nice if everyone online could co-exist peacefully and express there own ideas and creativity?
