How to DMCA Takedown Facebook Content you don't own ?

Hey Guys,

I have a number of Facebook pages and Groups that I am following that are clearly using Sponsor Content (mainly videos) without their consent and for there own gain.

I went ahead and tried to report a couple of posts/videos for copyright infringment by clicking on the post/video, hitting "OPTIONS" and clicking "GIVE FEEDBACK OR REPORT POST", only problem is there is no option to report post as a copyright infrignment.

The only options given are as follows -

⦁ Nudity
⦁ Violence
⦁ Harrassment
⦁ Suicide or Self Injury
⦁ False News
⦁ Spam
⦁ Unauthorised Sales
⦁ Hate Speech
⦁ Terrorism
⦁ Something Else

So this method of having copyright infringment material removed is not going to work.

Next method I found after searching around on the Facebook support section, is to fill out a "COPYRIGHT REPORT" form which is here - https://www.facebook.com/help/contact/1758255661104383

Only problem with that is on the Copyright form page it says "Use this form to report content that you believe infringes your copyright"

The keywords here are "REPORT" and "YOUR", so this method of reporting the videos would not work because I am not the Copyright Holder/Content Creator.

I tried looking up in the facebook support section if I could report copyright material if I am not the Content Creator and found a thread saying this -

"Can I report an infringement of someone else’s intellectual property (copyright or trademark)?

Only an intellectual property rights owner or their authorized representative may report a suspected infringement. If you believe content on Facebook infringes someone else’s copyright or trademark rights, you may want to let the rights owner know. "

My question for all you guys is -

Can you report a Video post on Facebook for Copyright Infringment when you are not the Copyright Holder for the content being reported ?

Even if it means falsley claiming that you are the copyright holder to get the post removed.

If you guys don't think this is a good way of taking down copyright infringing content, please list below an alternative method to do so.

Maybe you guys know of a website/service that can remove Copyrighted content from Facebook.

You cannot submit a removal request unless you are the owner of the copyright or their legally appointed agent.

Sounds to me you're just trying to take down your competition.

If you don't own the copyright, contact the copyright owners. If they choose to do nothing, that's their choice. It's not up to you to enforce other people's copyrights.

I once contacted a sponsor about a yahoo group that showed a lot of their content.
The sponsor went to the group url and looked at it and contacted me saying it was ok;
because the images all had their url on it. So it was free advertising in their mind.

We recently had a program, javbucks.com submit dmca's against several of or sites for using their feeds. They do not own the content. A Japanese company does. Whats the best way to fuck them in the ass?

You could file a perjury case against them, but why bother? People can send you a DMCA notice, if you think it's not correct just file a counter notice then they need to spend money to sue you if they want to take it further.

Just bat back invalid DMCA notices.

If I got a DMCA from someone.. who was not the copyright holder, and I detected you had anything of value at all, then we would be going straight to court and you wouldn't have a leg to stand on, the law clearly says your liable for all my court costs.

With social media I don't bother with DMCA's, look for breaches of the sites TOS and report those, its usually quicker and more effective.

I've never thought about this, but if you're outside of the US, your hosting is outside of the US then what happens if you just ignore a DMCA?

Most countries, including Australia, abide by the Berne Convention and the Universal Copyright Convention and their hosts honor DMCA takedown orders.

If I file a Copyright complaint with Facebook on content that is not mine, what's the worst that could happen (Content gets removed) ?

Will I be sued ?

If so, by who, the person that is stealing the content or the actual copyright holder ?

After all, this is just Facebook I'm talking about here, they aint the Government, I don't know, just saying, let me know what you guys think.

Its even better than that.. you can take them to court right here in Aus and then have the judgement passed to the USA, All you need to know is there's money to collect ;)

Sadly it works in reverse, make it in to a civil case, .. all that distress and anguish they caused you

I deal mostly now in making 3d content for virtual worlds, kids are forever ripping my shit and posting on social media, every few months I go on a bender to get it removed, heaps easier to get them on TOS breach than fuck with DMCA, and when I detect bigger companies I still don't fuck with DMCA, I explain how I will be taking civil litigation.

For cunts that live in fucked counties, work out where they are and contact the local cops.

This is the hard part Imo. Anyone can get a judgement.. obtaining a feasible writ of execution proves to be much more difficult. Most of the time, you'll need yet another attorney to handle just that part.

If you see infringement, notify the copyright holder. You wanting to lie to get it removed sounds nefarious. Your job is to tell the owner; period. Obviously the infringer will research for ownership and sue you for false filing.

Many companies have agreements so content is used but watermarked with urls so people can find more content.

I received money for infringement but a former employee downloaded unmarked photos and put them on my pay site. After a year of employment, I trusted him and didn’t check his updates. When notified, I was mortified and fired him. Luckily the photos were up about a week only and the owner knew I wouldn’t knowingly use stolen content.

I owed the fired guy two weeks pay and he agreed to forfit or be sued.

I’m curious why you want to report it yourself. Competition, as someone said, or ??? Use an anonymizer account to tell the copyright holder if you want to be unknown. But realize it may be authorized and the competition wants it there. The only counteraction I’d putting up your content to compete.
