Hurt Locker attorneys ask for sanctions against attorney that sold forms to downloaders...

Interesting development. The firm representing the producers of the movie "The Hurt Locker" are asking a federal Judge to impose sanctions against another lawyer that sold forms ($19.99) to the defendants in that case. He didnt represent the defendants just sold them forms they could use to defend themselves....

The attorneys for "The Hurt Locker" are claiming that the attorney that sold the forms knew the use of such forms would only cause undue delay and not be used in a manner consistent with federal rules of procedure. And thus they have had to expend $5000.00 in attorney fees opposing the form motions filed by the users.

Arent they basically trying to get a vending machine to pay because the item vended caused them issues? Seems silly.

sort of hard to make the arguement that "not be used in a manner consitent with federal rules of procedure" when one of the filing arguement (jurisdiction) has won already.

here in America the unusually high cost of auto, health, workman's comp and every other type of ins is due the over presence of legal action put forth by unscrupulous, greedy and unprincipled 'attorneys'... is that silly as well?

I just think it's silly that their premise is that a seller of a form has to somehow ensure that the purchaser is entirely familiar with the entire US legal code or in some other way ensure that the form wont be misused. I mean heck.

I could see a judge narrowing the issues on this one though. It wasnt just a form. It was a packet specific to this litigation to be used by these defendants. I think this one can go either way - judge's call.

Let's see what happens but my guess is that the Judge will dismiss the Motion for Sanctions. If he doesn't an Appellate Judge will vacate or remand with instructions.

I give Syfert credit. If he could have gotten 10% of the defendants to buy the forms he would have made a nice tidy profit.
