DMCA question

these faggots who are using the DMCA to protect themselves have to be DMCA compliant to get 'safe harbor' status. Part of that compliance is providing copyright owners with their procedure for handling DMCA copyright infringement notifications and then removing the content in a timely manner.

Is there a definition in the DMCA of what 'timely' is? Or legal precedent in a case where a judge defined what is considered how much time a thief/service provider has to remove the infringing content after he receives notification of the abuse?

there is no real time limit i have seen datacenters that will give you 24 hours and unplug your box and others that will give you a week to take care of it.

I would have thought once correspondence then 24hours should be a timely fashion. Without notification & communication, it could go on for months.

"Timely" has never been defined.

The longer they take to respond/remove infringing content, the stronger case you have against them if you sue them.

oh i have - that's why i'm asking the question. as a poster above stated there is no written in law number of hours/days by which the content has to be removed, it's too fucking vague - ridiculous, it should be 72 hours written in stone, there's no part of the DMCA that favors copyright owners.

You are correct, unlike Can Spam Act that is very specific and was proven effective, DMC Act contains alot of unspecified variables and overall it is extremely blurry. It has literally created the so called safe harbor upon which drastical changes have been taking place in the adult industry. For the time being I don't see an upcoming revision of it.
