which means if they take it down as TOS and the court ultimately rule that posting was covered by fair use (ala commentary was extended to include that) then manwin would be liable
if they wait for the DMCA then the copyright holder who issued the takedown notice has the liability

oh and btw the reason a web host removes the entire website when a user is banned is because the hosting of the entire site is the service you lose.
by definition the lose of the service is what banning you does.
that is completely different then a service which acts as a host on a video by video bases.
where each transaction is defined as infringing or non infringing individually
