Congratulations. The troubling thing here is that it becomes apparent that due to the fact this took 7 years to resolve the court system really is not designed for conflict resolution but instead the judges are like pit bosses that make sure everyone continues to stay at the table and keep gaming!

It was the Appellate level. This has nothing to do with judges milking it, they have nothing to gain. There are limited judges and tons of cases. Seven years is not bad from start to finish.

As I recall, Acacia was made up of attorneys. Having been in the biz I can assure you that they know how to use the system to make it expensive for the competition to proceed.

Congratulations, if the Federal Appellate Court affirmed the lower court's ruling summarily ? I'd call it a slam-dunk. Hopefully, this decision may set some new precedent however the next case is probably de novo.

nice to hear. On a side note, I'm really sorry Matrix is out of business since they made me a lot of money, but them being out of biz has some sense of poetic justice or karma or whatever you wanna call it

Those that caved can name themselves. I don't get to carve an Acacia leaf into their foreheads... but they do all owe us a thanks since we got them off the hook as well.

Age Check has been CyberAge since the lawsuit from AdultCheck in the 90s.

I can recall all the time wasted on this topic and the few companies who gave in to them.

Wow talk about sticking with something and following through, most webmasters have no idea what you've done for them.

Thank you for fighting the fight for everyone, it is very appreciated.

Ditto, and thanks for fighting that fight on behalf of all of us who got those letters (and for those present folks who didn't get a similar letter, but might have had ya's not stepped up to the plate and blasted a walk-off home run)!

Nope, if they agreed to pay then they can't ask for it back. What a shame... :winkwink:

Kolargol 10-09-2010 02:25 AM

Great to hear that. I wonder if Acacia harrassed foreign or only US based webmasters with their letters.

SGS 10-09-2010 02:40 AM

2003 seems like just yesterday.

Thanks... 7 years.

For us, most of the stress and bills happened in the first two years then we drafted on mainstream when they finally joined in.

Incredible though when you think about the effort to keep it together that long.

Well done. Congratulations.

This industry owes all who stood up against Acacia a great deal. If some hadn't had the balls Acacia would of rolled over most of us.

I want to send them a copy of "Godfather II" which contains the infamous "dip my beak" line that Berman used in that D$ interview.

Unfortunately, frivolous lawsuit countersuits are very rare in patent litigation and there is very little chance that Disney and others would counter-sue in spite of the ruling. The original judge basically already shut that sort of thing from happening down anyway. And that is for the entities that didn't settle... anyone that did settle would have even less recourse since they basically already agreed that the patents did cover them when they signed on to licenses. Regardless, even if they did sue then it would not have any sort of practical or helpful benefit to any other companies that paid off.

We all wish we could have our money and our seven years back but that is not going to happen. Acacia does have to cover some fees but not much else. Still, I feel that the precedent we set for other companies that might want to try something similar is clear - DON"T TREAD ON US.

That sort of resilience is priceless. :2 cents:
