There is no question, you can shoot photos and videos of people in the French Quarter, Bourbon Street or any other public place and post them to the Internet or show them on the TV news. As long as it's a public place, they are on public property and you are on public property, no problem. That is well established in law.

You can actually stand on the street, take a photo of someone in their house, and use it on the TV news. That is an editorial use of the image and is perfectly legal. Lots of legal precedent.

The difference here is selling the image. As soon as you introduce commerce into the equation, the editorial defense is gone (at least provided there is not a newsworthy element). The fact is, selling someone's image to a buyer, and that buyer selling it to a customer, on the 'net or a magazine for an ad for perfume, or anything else is simply not legal.

I'm not sure what case the judge in Louisiana was ruling on, but even if it was exactly the situation I just described...that would only apply in Louisiana. So, if you're selling the photo to someone in Louisiana, and they are only going to use it in Louisiana, and it was only viewed by people in Louisiana, they you might have a defense.

And even then, it is reasonable to say that people all over the world are likely to see the photo...but it is not reasonable to say that the person taking the photo is selling it to someone who is going to resell it.

That is a prescription for a very successful lawsuit.

Don't get me wrong, I love Mardi Gras and taking shots of the people there. But I also don't want to see anyone on this board get sued.

It is legal. Happens every day. But yes you can still be sued for civil damages and said damages have to be proven in a court of law.

Hence, you can be sued but that doesen't mean that you broke any laws.

IMHO it is a safer than a hard hard core webmaster running the risk with being popped with an obsenity charge, especially sites that display hardcore content with no age verification on tgp's etc...

I am using the extra cash to stock up on smart media cards.
I can get about 300 good pics, or 50 videos on a 128 meg smart media card
So the more I can get, The more I can shoot with out having to go back, and upload and then clear the cards for another round.
I rather walk the streets for 12 hours shooting, then having to run back to the apartment to download every 4 hours.

I'm leaving Feb19th returning on March 8th

I have over 4 hours of video to edit.

I wanted to send both sets out on the same cd, that way since I'm paying for postage, I could save a little money

I'm still working on it Uncle Jimmy, I have been a little busy with trying to find those battery packs, and (2) 128 smart media cards, for a fuji 3800, different then the 2800's.
But I finally got the (2) 128 meg cards, now just waiting on info for the battery packs.
So far all I have done is about 60 of those bike babe photos so far.
But I'm trying to get about a 150 or so of them together, before releasing them

Can't wait for Feb 19th to get here.

I also had to get 2 other 128 meg xD-Picture Cards, becuase my new fuji 3800 uses this new type of smart media card, and it's different then my other fuji 2800 that uses the standard 128 meg smart media cards
