A "defamation" can be any form of "communication" . A communication is defamatory if it tends to expose a person to hatred, ridicule or contempt. If it harms the reputation so as to lower him/her in the estimation of the community or to deter others from dealing with him/her.

Therefore asking a question that would lower a person's (in this instance a body corporate ,or legal personna) esteem within a community or affect others from dealing with him would be libellous if untrue.

I'm not a customer of yours. Therefore, not a beta tester. I was just curious because you had all of your clients so excited about it, they were pushing it as if it were their own, all to be released on August 9th I believe it was.

And then your clients were so heavily endorsing your booth.

I totaly agree, If acustions are FALSE, one could be held liable (it would cost the sueIE more money to sue then what the false acusations cost him).

However, my Lawer advised me that If a pariculer individual would have proof of wrong doings of another, he could go public and would not be held liable. I guess public anouncment would be seen as a warning to peers.

i'd say that dynaspin should have done some research before just up and leaving because of a random basically anonymous posting on the interweb about your company. the witness who did not sign up because of the thread... same thing. besides. if they're THAT easily swayed, perhaps they wouldn't have been such a great customer after all. who knows if 2 or 3 months down the line they'd just bail on you to some other host which charges a penny less per GB or something. i'm sure you've seen this happen, as have i, over the years (and it totally sucks, especially if you've put hours of work in to setting up their web space just as they want, too).

basically, tho, the end result can't be used to determine if something said was libel/defamation.

They can't even pay their AllLiquid affiliates. Just goto AllLiquid and read the thread yourself. SEVERAL people have not gotten paid.

My best friend's dad also owns a very well respected company that does the booths for shows. A booth is not late or is never finished. There is a contract between the company buying the booth and the company making the booth. If the booth was late then we should all expect to see a suit from LWI (not that would post it publicly but just do a search in the next couple of months).

Also - where is this big bad 10G network? I just did 15 traces from random places around the world and it all goes to MFN.

Last I heard MFN was in bankruptcy so it is pretty apparent that LWI is not interested in spending the bucks to get a decent provider or two in there.

Have you seen the prices for their hosting? They are juicing a ton of you people that is for sure. And it is definitely not going into support because I see a ton of threads here about people not getting good support from LWI.

I think they are hurting for money. That or their big bad ass ?CEO? that can ?own? everybody is taking all the money. They are going to even have bigger problems if they don't start paying their affiliates.
