Since you do not sign a contract yay or nay when you sign up with an affiliate program typically, there is nothing to show them to claim he is violating anything or breaking the law.
You can try and string together two distant points and claim he is breaking the law or doing something shady, but merchant banks and web hosts are not just going to pull down a company because of some complaining affiliate. It would take a lot more to get them to pull the plug.
Even then, he can kill the affiliate piece of his program. just go get another host and merchant account or third party processor and be back up in no time.Comment

The FTC is not big on online scams, but I doubt they would come to the aid of small business pornographers.
