Windsor, Ontario -- Canada's failure to change its marijuana laws as ordered by an earlier court ruling caused a judge to drop a possession charge against a 16-year-old boy Thursday.
The case amounts to a challenge to the validity of the Canadian law that makes possession of marijuana illegal.

Lawyer Brian McAllister argued in court that the federal government never reworked its marijuana laws despite the 2000 Ontario court ruling that it should make medicinal marijuana available to legitimate patients.

Instead of writing new laws, the government passed regulations to create a medical marijuana system.

McAllister argued that the situation means Canada effectively has no law prohibiting possession of about an ounce or less of marijuana.

Justice Douglas Phillips agreed, dropping the charges against the youth, who cannot be named because of his age.

While the ruling involves only one case, it signals further momentum toward the possible decriminalization of possession of small amounts of marijuana in Canada.

Two Parliament committees have recommended eliminating or easing laws against marijuana possession. Justice Minister Martin Cauchon says he will introduce legislation in upcoming months to make possession of small amounts of pot similar to a traffic violation, punishable by a fine with no criminal record.

U.S. officials oppose any moves by Canada toward greater leniency, warning of tighter border controls to combat increased smuggling.

Eight U.S. states have taken some kind of step toward permitting the medicinal use of marijuana. The U.S. Supreme Court, however, has ruled there is no exception in federal law for people to use marijuana, so even those with tolerant state laws could face arrest if they do.

I dunno, man...anything to get more negative press for the drug war is a good thing. Declaring (drug)war on Canada will strike most, if not all Americans as hella stupid, and get even more press going. The best thing that could happen would be nice, harsh, DUI laws. Then all them baby boomers that smoke on the weekends would get to take a nice piss test, lose their driving privliges becaused theygot high two weeks ago, and finally get off of their hypocritical asses and vote like they really think, not like the Republican National Convention bastards tell 'em to.

Just going on the article I read er somethin online about it.

Saying that the US didnt want Canada to soften penalties or whatever, claiming it would stiffen transportation fines and penalties.

Thas what I read anyhow...

I keep hearing about how Canada is going to leagalize, but I don't buy it.

After stomping on Iraq, Canada will be next. The current administration is not going to let a country exercise their own free will if it goes against the presidents agenda.

They aren't really going to attack but they will strong arm them into going along with what we want.

I'm pro-legalization too, but I haven't smoked in years... I just think that jailing pot smokers is like putting harmless panda bears in jail... what's the point? As if a completely stoned MJ smoker is going to have the motivation to commit any crimes... I think not.

Unfortunately, the US has a lot of financial ammunition to "influence" Canadian drug laws. Tariffs ( or import quotas/restrictions) can mean billions of US$, and are a major policy issue for any other government.

Pisses me off.

I idea of dumping folks into jail for smoking some weed is absurb. Even more absurb is action to stop folks from accessing pot for medical use - that is more "criminal" than the act of smoking it.

The US has prided itself on having "freedoms", but sadly has more laws and restrictions on its own citizens than any country in the western world. The prison population exceeds that of any western country, - many inmates are paying the price for having a puff of Mary Jane.

Pot has been legalised (or never was illegal) in other countries as well as Canada and this trend will continue - there are far more important "crimes" that need attention than smoking pot. The sooner the US Admin admit this, the more the US taxpayer *may* see some taxes being put to better use. But the "control culture" in the US ain't going to be relaxed too easily under the current Admin - so little hope of that...

More and more people will start to see how much bullshit the war on drugs really is and hopefully will actually START VOTING their opinions.

Hey remember those Super Bowl ads that said that if you smoke pot you help terrorists? Did any one actually fall for that bullshit? Fact is most marijuana is not imported into the US from Afganistan, Saudi Arabia or anywhere in the middle east! It either comes from Mexico, Northern Cali, or Canada. Why dont they make a commercial: I smoked a joint... I helped fund those damn Canadians!

Canada is not legalizing pot. They are planning to decriminalize it. Big difference. Smoking pot will still be illegal in Canada but you will only get a fine if you are caught with 30 grams or less. It will be the same as getting caught drinking booze in the park. No criminal charges, just a fine. Selling pot, or possesing more than 30 grams, will still be illegal and give you a criminal record.

Man I got out of a pot conviction years ago by arguing church and state. I know that's an American thing, but it applies in Canada too apparently. I was in custody for about 30 minutes after one of my neighbors got pissed off about the smell coming from my pad, and the cops came in and found my plants. I didn't call my lawyer, mainly because I don't have a criminal lawyer and I wasn't about to get one for this bs. I started quoting the Bible (well close enough anyway), "and The Lord said, I have given you all the seed bearing plants and herbs to use", etc. They couldn't argue, and let me go, basically telling me to put a towel under the door at my place. They did get pissed when I asked for my plants back, though.

Sadly, it will be a long time before people in the US vote for decriminalizing weed. It didn't even go over in Nevada, that was a real setback.

Man, we laugh at the propoganda in Reffer Madness, but it's even worse now. Have you seen that commercial where the teen girl smokes a pipe at a party and the gets raped because she's high? What the fuck is that? Propoganda like that does way more harm than good, THAT should be fucking illegal.
