Complaints filed in pornography case

Comments? Do you believe that a parent showing their child pornography places that child in "imminent danger of mental impairment"?

Complaints filed in pornography case
By Joe Gamm

Two complaints have been filed against the Amarillo man accused of forcing his 8- and 9-year-old daughters to watch hard-core pornography.

Randall County District Attorney James Farren said Monday that his office filed two complaints against the Amarillo man after he allegedly showed the girls pornography.

Police reported the incident to Farren's office in June last year after one of the daughters told a counselor that her father made them watch adults have group sex and performed other acts online in his home, Farren said.

But the public indecency law prevents the prosecution of parents who show their children pornography.

The law was apparently meant to protect the privacy of parents who wanted to teach their children about sex, and states that parents can't be prosecuted for showing "harmful material" to their children.

Farren said according to the Texas penal code "harmful material" such as pornography is considered defensible from prosecution if it is shown to a minor who was accompanied by a consenting parent.

The girls' parents are divorced and share custody. The girls' mother wants her ex-husband to be jailed.

Farren said his office is banking on the child endangerment statute, which says it is an offense to recklessly place a child in imminent danger of mental impairment.

A conviction on the felony would mean the father would face up to two years in jail and a $10,000 fine on each charge.

"There is no built-in defense in this statute that a consenting parent allowed the children to view the material," Farren said.

After deciding not to pursue public indecency charges against the father, Farren had asked the Texas attorney general's office to look at what outcomes he might expect if he pursued a criminal complaint against the father for showing pornography to his children.

He said he wasn't surprised last week, when the response came back that there was a defense that would keep him from winning the case.

So, he began to consider using the child endangerment statute.

I would never show my kids hardcore porn, but don't have a problem with erotic pictures or any kind of nude bodies.

If you ask me it should be classified as "sexual interference" just like any other molestation in this case. Sitting your preteen daughters down and forcing them to watch hardcore porn is going a little beyond good taste, and crossing into sickfuck land. but as usual with this sort of case, it is a slippery slope with a lot of variables. If they outlaw this, could fathers around the country be facing sex offender charges when their boys find a few dirty mags and get caught with them showing off to their buddy's at school? I mean who hasn't done that? I think it should be prosecutable as sexual interference, upon which cases are judged case by case, but hey, I'm no lawyer, so I dunno the deal...

I remember listening to a conversation between my parents and my Aunt and Uncle about this topic when I was a kid.

My Aunt and Uncle said they had educated their children about the human body and sex. Because of that, they would rather their kids watch adult material than see all the violence that is shown on TV.

Meanwhile....I was sheltered from "pornography" and look where I ended up. ;)

I don't think they have to choose...they don't have to show them any of it.

When they hit puberty, I would surely rather have them watch porn over violence.

qft

If these were boys would this even be in the news?

I don't agree with showing hardcore porn to kids that young however... I can see tasteful porn being used as an educational device.

Besides... what I consider wrong and right doesn't matter. It's up to the parents. I don't think Creationism should be taught as fact (mainly because it has no evidence) but that doesn't mean I would want to strip the rights of parents to teach their children Creationism!

Kids are having sex at like 10 and 11 now a days so... maybe some sex education is needed a littler earlier now? Besides it simple stated "hardcore porn"... That could be an educational video for all we know...
