ontario people - should i fight a speeding ticket that has the wong info?

So I got a ticket the other day for speeding, nothing too bad but all of the information is wrong. Wrong name, wrong address, wrong drivers license number, wrong birthdate, wrong time. The only thing right is the license plate number and the infraction. The fine isn't much, I wouldn't care if I had to pay it but I don't get what happens if I do since nearly none of my information is on the ticket...

So basically what you're saying is you didn't get a ticket, someone else driving your car did. Cars don't get tickets, drivers do.

So yeah, fight it.

You should dispute it even if the info is right! First there's the chance the cop won't even show, it's not unlike "fold equity" in poker. After that you can always plead to a lower fine/no points, it's always worth your time.

All you have to do is prove a "Reasonable Doubt". Can you do that if some of the ticket information is incorrect? Yes. I would probably say something to the effect of "Well, the officer obvsiously wasn't accurate enough to write my correct information on here, how are we to know that any part of this ticket is correct?" <-- Reasonable doubt. How can they charge you with _____ speed, when they can't even write your name properly?

i dunno,,,my brother tried to do this, the judge just amended the mistakes in the ticket because he was in the wrong, as you probably are. no point to fuck around with the system, you're just wasting people's time, pay the fine, don't be an asshole.

if you have Mr Wong's info then you should probably call him and/or mail him the ticket.. The ticket was issued to him, and not you.. no need to panic

They will be able to tell you your chances of beating it I would think.

Depends on whether or not it is worth it to you to fight it...re: your insurance rates, the time you have to take off to go to court, etc.

In most cases it's easier to pay it, unless you are looking for an excuse to take a day away from work.

edit: if you throw it in the trash, the next time your license renewal comes up you will have to pay it before they renew your license.

you don't even need to dispute it .. go to a station... preferrable the one from where that officer whom issued the ticket is from .. bring it in . they will check to see if your ticket ever got registered .. but probably not .. sounds like the officer double printed the ticket that he wrote up before yours.

Happened to me in Nov ... a 500$ ticket for driving with a revoked permit. I went to the station, met with the officer that issued the ticket .. he had to delete the ticket issued because that person gets a double offence. I walked out 500$ richer

the officer had explained to me that only once they print the ticket that the ticket is issued and registered in they're system ...
So your infraction was never issued and there is no time limitation on infractions .. so your in the clear .. but best to be safe and go to station to verify that your infraction was never printed ... cause remember this .. once your in court .. they can't dismiss a ticket they know nothing about. if it was registered, then you'd be in court fighting the ticket for the name on it .. not yours .. they have no way of knowing which ticket is yours in court. so the judge will preside over the ticket you contested, but not your original one ...

Not sure how the laws are there any any ticket in the US is best to take to court. chance that the officer wont show. Ticket dismissed for lack of prosecution. Change the officer does show and has no Independence recollection of the incident, dismissed for lack of prosecution. Just have to pay attention and say the right things.

throw it in the trash, and a year from now when your license is suspended, and the notice is sent to the wrong address, you will be pulled over and arrested for driving after revocation

That's about the worst thing you should do, don't throw it away.

Well I went in and according to the person I spoke to, its the other guy who would have gotten his license suspended had I thrown it away. Anyways, it looks like it is going to be 'withdrawn' since nearly nothing is right on it. Won't have to go to trial or anything.

I hit a car a few winters back and the cop said that he would bring me my ticket at a later time! ROFL I never got that ticket, accident still isnt on my record, although I did get frauded out of about 800 dollars... the person I hit acted like the insurance company and sent me letters saying I was to pay x amount each month, blablabla... well I paid it but what I think ended up happening was that the person I hit was taking the money orders I was mailing, and sending them in as their insurance payment hahah.

I stopped paying and have never heard a word from them again... this has been like 4 years now.

So now I pay $130 a month insurance on a 10 year old car with comp, collision, and $500 deductibles. Fucking gay.

And my insurance company wants to meet with me next week to discuss renewing. I already told them if I aint paying at least $30 less a month I will be shopping around.

Wow... way off topic. I'm good.

Nice. I would never fight a ticket in the courts by myself. If a court hearing you have an attorney show up for you and bring to light the errors on the ticket... thrown away.

Going in yourself... the judge will just ask you... did you get a ticket that day or not?

Congrats on the station visit... your best decision right there.

A friend of mine's father was one of the top paid cops in Ontario. You know why? Because he wrote alot of speeding tickets and showed up EVERY SINGLE TIME for court. He got paid time and a half to double time for his court time.

Since its not you on the ticket and a speeding ticket is issued to individuals instead of cars, I wouldn't worry about it. But I wouldn't throw it out either, I'd go to the station that issued it and tell them. If they don't give a rat's ass, then use one of those ex-copper services to get rid of it.

if you have a USA license it will not report back to your home state if u got ticketed in canada. they may sent BS mail, but use it for toilet papers. they're not wired into NCIC and chances are your local county (assuming you're american) gives a crap that you got a ticket in mooseville ontario

BUT since it's not in your name or DL number, why bother? It's not YOU who got the ticket afterall; some poor soul did. Anyway, wait and see if you get a court date in the mail
