This is like making no mention whatsoever regarding mailing in your ToS, the terminating some doing email promotion and screaming fraud. Even if they were mailing in compliance. They have done nothing wrong. You overlooked mentioning a legitimate means of driving sales which you disagreed with, and that is YOUR PROBLEM. Not that of the person who was payign to send you traffic.

If it was such an issue, you would figure that he would quickly add that in the TOS to prevent this scenario from reoccurring.

But since he didn't, it comes off as a scheme to continually fuck WM's out of money with little 'gotcha' games.

you've had the issue explained to you by shoehorn and a hundred other people, many of them who probably don't even know shoehorn - he was not breaking any rules, he was doing what hundreds of other webmasters do. you don't like what he was doing, too fucking bad, you never told him that until after the fact, using trademarks/domain keyword phrases is done all the time in this industry for PPC ads, so don't try comparing it to shady practices like carding that are universally unacceptable by all programs. change your Terms, pay him, and move on. There is NO PRINCIPLE here for you, there is for Shoehorn.
