Every example you just gave is blatant fraud. Everyone knows carding is fraud. Try to have more sense. I sent you legitimate sales through a tried and true advertising stream.

The screenshot I posted was for a mainstream program that clearly defines what not to bid on when promoting them via PPC. I can post screenshots of affiliate programs that allow any keywords.

If you have outlined that you didn't accept PPC traffic it would be a different story all together. Fact is, you took my traffic and sales for several months before deciding to not pay me.

You are a thief. People can see that you owe me money and aren't paying. No matter how you try to spin it, you are wrong.

Dress it up however you'd like. Between cookie stuffing, carding, and bidding competitive terms, two are fraudulent and one isn't. His leads were IN NO WAY FRAUDULENT.

Putting together a keyword list, most marketers check the terms to see what keywords are disallowed. Places that don't want to have competition on their terms lay it out plain and clear, and if there is nothing specifically stated, it is free game in the PPC world.

If he was sending you junk signups, then it's understandable. this is your loss and your fault, and he spent his money promoting your program 100% legitimately.

It's a shame that ego's have gotten in the way of a sensible business resolution.

Actually, if you don't have clear terms, then technically you are responsible for paying on any sales that don't violate US law. Carding and cookie stuffing are two completely different animals, one being illegal and the other not.

Any attorney would tell you the same thing.

I recommend you consult with one ASAP and rewrite your TOS..

And I know he is hurting for sales. How do I know? Because he picked my sales out, looked where they were coming from, decided he didn't like PPC campaigns for whatever reason, and stopped paying me. Any affiliate program doing a substantial amount of sales a day wouldn't be watching ever little sale to see where they could rip off an affiliate. And if they found an affiliate doing something they didn't like, they would contact them and tell them to stop, not make up some bullshit about violating their TOS, when its been proven that there was no TOS regarding PPC traffic to begin with.

Probably lots of affiliates getting paid fine, this is one case that just stands out as showing that the program has no problem making up the rules as they go.

I had to go through this shit with CommissionJunction in the spring. Suddenly they decided that my links were receiving a tiny amount of traffic from somewhere on myspace, and we're talking like under %.1. They reversed about $3k in payments on me that I was hanging a big loss on.

I emailed back and forth forever, and they made it perfectly clear they weren't paying me. Then asked me to keep sending traffic to their merchant. LIKE FUCK I'D SEND THEM ANY MORE TRAFFIC. I requested that they terminate my account.

Mysteriously a few weeks afterwards a check shows up from CJ. WTF?

I still ain't ever promoting CommissionJunction ever again. It burns because I occasionally see something CJ exclusive I really want to promote. Yet that fucking burn still keeps me far fucking away. You really think he cares to come back for another burning after you just lit him up once already?

This making up the rules as you go shit has got to be kept in check. Just because you're the one writing the check doesn't instantly give you the right to start fucking people "just cuz", when they've done nothing in the wrong...

The right thing to do is to pay the man for his work, rewrite the ToS, and put it behind you. No one is arguing that you can't put these rules out there if you want to. But if you didn't specifically state that this was against ToS, then nothing illegal has taken place, and the sales sent were 100% legit and qualified.

It's the way you've handled it that really leaves a bad taste with people...

Fuck, I even got paid in the end and I still am bitter and turned off of their program!
