Sirkin is a smart guy. He made some solid arguments. I am disappointed that the 11th Circuit thumbed their collective noses at the Ninth Circuit's decision that a national community obscenity standard should be used for the internet, but thats Florida. For the most part they arent adult friendly.
The decision will be interesting but I doubt he will win -- just a hunch based upon their feelings towards the Ninth Circuit's decision in Killbride.Comment

Max is not a nice guy in my book; but, I think he should be able to make his movies and sell them to people who want to buy them as long as the rest of us don't have to be exposed to his depravity without our consent.

I visited him in the Federal holding facility in downtown LA in early September. He was in good spirits, and was hoping his appeal would be successful. For a guy thrown in jail for doing something he didn't do, his attitude was remarkable.
I really doubt that any of the keyboard warriors in this thread could deal with the Kafkaesque situation Max has found himself in.Comment

you tried to make the point that "justice wasn't served" - my point, which would be fairly obvious to anyone not busy ramping up quota driven, billable hours with questionable items and for any contrived reason,... was that many in Florida would agree that justice was served.
its a subjective concept... hence the need for a judge and jury to make the final decision.... and the opportunities of the prosecution and the accused to argue their case.
and as you well know .. process was followed and he was convicted by a jury of his peers with every opportunity to argue his case. he and his attorneys failed. he was judged.
end of story.
when you play with fire... you get burned. when you push the system and people... eventually the system and people push back. when you position yourself as the worst of worst and scream "fuck you" while you do it... it can only have one outcome. arguing the specifics after the fact is pretty retarded when the risks of his behavior and attitude were quite clear.
we are talking about a guy who happily screamed "fuck you FBI" on this very board while being under investigation and having his office raided... and a guy who pushes the boundaries so far that the vast majority of the people in this business (complete degenerates that the are), are repulsed by his movies. lets not pretend he was just some innocent girl scout, selling cookies door to door, who was snatched up by men in black suburbans, taken to a secret CIA base and wrongly accused of trying to assassinate the president of USA.

Its interesting that you say that since I have a double major in Criminal Justice and Psychology, taught by then current and former FBI agents, and wrote a 180 page thesis on the case studies of 5 serial killers that was read and graded by the former head of the Behavioral Sciences Unit for the FBI at Quantico Virgina. And I can tell you that each serial killer has a different story to tell. You have to look a little beyond the surface to find the truth.Comment

Different story or not.. they all did what they did. if you majored in psychology then you know that first and foremost, they are broken ... and the acts they committed are evidence of that simple incontrovertible fact.
You don't need to look anywhere to know that when someone is out there killing people, their motivation, their personality, their taste in music and whether or not they are charming people, has nothing to do with the fact that they are in fact, serial killers.
... just as i don't need to know how Paul Little feels about his grandma or Britney Spears to know he's a depraved shithead with a fuck you attitude. He did what he did.. and he loved every second of it and he's proud of it.

Good points, but plesurepays has a serious dislike for Max hardcore. Nothing you intelligently point out will make him see anything other than Max did it and he is being punished rightfully for it.
What pleasurepays does not get is that Max is getting punished under a bad ruling due to a very poor interpretation of the obscenity law.
This poor law interpretation and bad ruling has serious consequence for the adult industry down the road, if it is not over turned.
Im cool with Max getting jail time for assault and battery or even rape(if the facts support it). I really dont give a shit what happens to the guy. But i do care when Max gets his civil liberties taken away.
WHY DO I CARE?? Because if his can be taken away, so can mine.
You need to look at this case for the facts and without your personal feelings about Max Hardcore. If you can do that, you will really see what a travesty this case decision really is.
