German law, following European Union directives defines now, for the purpose of child pornography

Child:
anyone under 18, or looking under 18, or drawings and depictions of anyone looking under 18
So 25 year olds with pony tails would be children, even with 2257
(I thought children were under 14 or under 12 by most legal standards)

Pornography:
anything slightly erotic or suggestive looking.

So adult erotic can become child porn.

Furthermore it describes how mainstream movies and mainstream magazines collected from the 70ies and 80ies (with occasional nude photos of 15 year olds), and legally produced porn and erotica from the 80ies now suddenly became criminal items.

I think what they mean is if you shoot a 19 year old and your promoting her as a teen under 18 or the deception of being under 18 they will charge you with child porn just make it where they just had their 18th birthday and its all good

I read the original sources, respectable magazine "Der Spiegel" and germal legal sites.

It looks like the state attorney actually can look at the photos and decide if he thinks she looks underage, and then it is trouble.

Strangely there are no English language citations, but the law is mainly german. Seems the Brits are on the same path, though. Aussies have similar stuff too.

This is probably trouble for all exactly 18 Teen sites which surely have half their girls looking 17 or under. Very problematic law. I mean that is the whole deal: get legal girls that look as fresh and young as possible. Nobody wants a teen site with true 18 year olds that look wasted 24.

Maybe they let the law sit for a few years, quietly, and then start enforcing it with vengeance.

If anyone gets more literature, confirming or disconfirming, that would be useful for everyone. Especially those who live in Germany or want to travel to Germany at some time.

That remind when i got server shutdown on 10tb because some german sended automated mail saying how he cant look at site because German law forbid it but he saw my site on some stupid list and they automatically concluded how there is cp.

Both issues have featured recently in Europe. Back in November 2008, Hustler Europe filed a constitutional complaint against a section of German law that criminalises sales and distribution of content depicting "adult actors who show a youthful appearance".

It would also be interesting if, in exchange, they would allow porn with older looking, adult looking minors. Of course they will not.

As there are 12 year olds that look like 18, and 27 year olds that look like 17, the german law really will create confusions. Best is to settle only for MILFS and Grannies. Of course, that could be qualified as extreme or disgusting porn and thus also be excluded.

strange.. i mean germans are one of the most liberated sexually people in europe.
tons of porn were produced in germany in the 80's and probably still is today.
still in many european countries nude photos of 16 yo's in magz (non explicit)are quite common or least it was up to a few years ago...

I wish you were right. You saw the "Guardian" quote, there are German law magazines, the Spiegel etc.

And it is NOT if you claim they are underage though they are not, it is if someone THINKS they could be underage. In the US it seems this is illegal

Underage porn and underage sex is the modern witch hunt. Absolutely crazy and against all legal concepts. Guilty unless proven innocent. The feminazis worked towards this for decades, and they are winning. On all fronts.

The age of consent for sex and for porn will be 21 by 2020. And if they could they would set it to 28, but they might not succeed

I'd have to read it and understand it myself first but I'm sticking with a poor interpretation of the law until then.

There are already similar laws around other parts of the world where it is more to do with 'made to look like they are underage'. I suspect that is what this is about also.
