poor guy, but this is what happens when you trump all progress with copyright/trademark laws.

The moment you start with the "you cant use that word" these things will occur.... even the lawyers claimed there is no infringement.

Fuck Monster. Their energy drinks taste like shit anyway. I still have 3 out of a 4 pack sitting in my fridge from about 2 years ago, when Full Throttle wasn't in stock. It seriously tastes THAT bad that I couldn't open another one.

But

Hes only being asked to change the name of a beer... not the name of his business.

Financially he shouldnt... but being a man of principles... im sure he will drain a lot of money that his kids could benefit from to try and retain his beer name... and most likely lose it...

Monster Energy drinks are now in distribution deal with Anheauser Busch, if David ever wanted to fight Goliath, going against inBev/AB will be it.

Nadeau contacted Reed to say the products are in two different markets — beer and energy drinks — and offered to surrender any rights to use the name on an energy drink. According to Nadeau, Reed said that's not Hansen's concern, but that Hansen wants to enter the alcoholic beverage market.

"I said `Too bad, I'm already here.' I've been here. And I'm already brewing beer," said Nadeau.

So lets get this straight.

Guys been making beer.
Another company has been making energy drinks
Energy drink guys want to make beer
Energy drink guys sue brewer who has been making alcoholic beverages before they were.

Should the brewer being suing them???

sorry i was talking about the situation not the guy. I agree with him, i don't think vermonster or whatever the beer is called is a trademark infringement on Monster Energy drink.. i think it's make work for the lawyer.

a vermonster beer being a trademark infringement on a beer that doesn't exist is an extreme stretch of the imagination. If this vermonster brewery wanted to make an energy drink i can understand, but if it's the other way around that starts to make me feel afraid about any business or idea i come up with being completely walked over by people with the money to simply buy a judge.

Just had a few issues. He is a fucking corporation himself so stop bashing fucking corporate America. He became a corporation for the same reasons they all did. To take advantage or tax codes, to protect assets, and all that other crap.

Stop with the boo hoo about 1 billion dollars. You do not need to say it that many times. It does not change things. You can still win as a small guy and appeals do not get to go on and on forever and ever. 1 billion dollars, damn and to think people go up against the entire US government on cases all of the time - I did.

It is not necessarily buying justice or the courts. Yup money sure in the fuck does help. It is a way to fight and to speak. Using the media, news outlets, grass roots movements, and other such tactics also are another way to fight. Actually would give him the upper hand to kneecap the giant by harming their image and sales much more than they ever would win, or even make worthwhile to them after some point in time.

This has more to do with the way our trademark/copyright laws are set up. The problem is if Monster doesn't protect it's name then the next time someone makes a "monster" product they can use this guys beer as precedent to say that they are not infringing. Instead companies are forced to protect their property tooth and nail. Don't hate the player hate the game. That being said monster tastes like shit so I will not be buying it anyways.

Marketed and distributed by Hansen Natural Corporation, a NASDAQ listed company of Corona, California. Though Monster Energy is not widely advertised in the media it receives a large amount of recognition from its sponsorship of various sporting events. Hansen Natural Corporation announced a distribution agreement with Anheuser-Busch in the U.S.[2] and Grupo Jumex in Mexico.[3] Hansen Natural Corporation has recently announced a distribution deal with PepsiCo Canada. On November 10, 2008, the distribution of Monster turned over to CCE, Coca Cola United, and other Coke bottlers in many markets. Contracts with existing distributors were bought out in these markets. In late 2009 or early 2010 Monster Energy will expand their market and release their products to other countries including Germany. It is distributed in Australia by Schweppes.

Could of been much better. Needed more product placement. Should of been a sign with his main best selling beer in view, not just the occasional name of his brewery. He mentions he best selling beer that paid for that factory and put more sand and sawdust on the floors. However I can not remember it.
The special ED beer he is fighting for is burned into my brain but it is a special edition, one he could loose or fold his hand on. He needed to take some que's from some Samuel Adams commercials.

I understand not protecting your brand. There also is the whole issue that even though they are in the beverages markets - one is alcoholic/adult and the other is in the non regulated beverage market. Very touchy and could be too close, but that would be up to some 13 other people to decide.

I do have stronger issues with the ease at which the wrong types of words can be dropped into TM/CR protection. Shit like "Your fired" and other crap should not happen.
