There IS a duplicate penalty but it doesn't work the quite the way it is generally assumed to work.

Duplicate content works to harm your site's SERPS through:

Dilution of link popularity
Canonical url issues
Branding disruption

as i've always said... there is no such thing as a duplicate content penalty in the sense that people think there is.
