So what is the process of doing this, just surf to any site rip the content and claim it as yours?

This is why I think paysites with premium content will never go completely bankrupt. You start with a video, we'll call it "Barely Legal Woman of Loose Sexual Morals Hoovers Giant Black Cock", or BLWLSMHGBK for short. Now BLWLSMHGBK starts on a paysite with a resolution of 720x360 and it looks great, but Tube Site Owner A hires Outsourced Indian A to rip the member's area of the aforementioned paysite, crop out the original watermark, and upload it to his tube site where it's re-encoded with a loss of quality and a new watermark.

Now Tube Site Owner B, seeing Tube Site Owner A's wonderful copy of BLWLSMHGBK, uses wget or something similar to grab that video, and then re-uploads it to his own tube site where he must further crop the video to remove the watermark and add his own, again, with a loss of overall video quality.

Now rinse and repeat this cycle three or four more times with Tube Sites C, D, E, F, and eventually we're left with a video that's been cropped so much the resolution is now 320x180, and has been re-encoded so many times it looks like a very excited pair of blurry black and white dots, which, surprisingly, some surfers will still be able to spank to. Others, however, will want to see the original video in pristine quality at an acceptable price point.

This is one thing I worry about hosting a legal tube yet also allowing user submissions. This kinda of stuff is going to happen at some point and the last thing I want is for some company to get pissed at me for something a visitor uploads. I could always forbid user submissions but I think some of this hard amateur content will get traffic to the site and then users may stick around and look at the other sponsor's videos. I just don't want to see someone jump up and claim copyright violation as have been seen in other threads about "user submitted" content.

Any advice on best how to handle that situation?

I agree if those displaying the content hide behind DMCA to violate copyright law but if a site in good honest intentions removes content that violates the author's rights, then DMCA serves its purpose in safe harbor laws. Sadly the problem is some sites will use DMCA to claim user submission to relieve themselves of responsibility which makes it harder for those of us trying to do it the right and legal way.

I dont agree. If stolen content is displayed for 5 seconds or 5 weeks, they should still be responsible. For all we know they are the ones loading it themselves, then when it comes to someones attention, they take it down. I DIDNT KNOW is no excuse. With all do respect, that's a bit irrational. Even someone as big as YouTube with far more staff than tube sites could not even meet that type of demand. Still, that's a bit hypocritical especially for an online industry that got it's start by scanning and posting Playboy and Hustler pictures.

Here is why your example is flawed. Say Company A isn't making any money and uploads their videos to a tube site (as a regular user) and then turns around and sues the tube saying they do not have the legal right to display the content. Nice payday for a failing business. I am right there with you that if the tube owner knows for a fact the content copyright is violated that the content should be removed immediately. But whats to stop other competitors from trying to invoke DMCA to have their competitors content removed from a site?
