Question regarding buying a new car

Ok last thursday we entered an agreement with a dealer on a new car. Price, interest rate, etc. Ok we get a call today saying that CEFCU what's a higher interest than what was agreed upon but in exchange they are going to drop the price we negotiated on the car. I thought a deal was a deal. Can they do this? Can we just tell them here's the car back and forget about it? We signed all the paper work on the car thursday.

Gary,
I had a similar experience. Call them and tell them you're returning the car as the deal proposed doesn't match the contract you signed. Walk in with the keys and put them on the desk of the manager, and have the contract shredded with an addendum stating you returned the car and the deal is void. Keep this record.

When I went to hand my keys in, I got to the desk of the finance manager and magically they were able to hold the deal as per the original terms. By some kind of miracle I guess.

But this voids the contract so you can release liability - from what I gathered and what I experienced.

Ok we had a trade in too. If we returned the vehicle do we get our car we traded back?

I'm not sure what the legal issues are, but once you sign your name on their contract and drive off with the car, they can't change the deal.

A dealership did this to me with my first car. I walked in, listen to their story, said no, and walked out. The car was mine, legally in my name, and that was that.

They would in that case have to return your trade in to you in the condition you gave it to them in.

Be aware this is CA law, and I consulted a CA lawyer. This may be very different in IL.

But the more time you waste the worse off it will be. So go in with the keys and get it done now or there may be a time limit. I think it was a week in CA ( don't recall the exact time frame sorry )

Thanks Brad and Rochard for the advice. Did a little search on it and found this. http://www.illinoislegalaid.org/inde...ntentID=25 00

Going to take the car back tomorrow after we talk to our lawyer.

Sounds like one of those scams I read about recently ... I think it was on yahoo.. dealership scams..

they do a deal, get you all signed into paperwork, then change the rates hoping you'll bite after all work you've invested to get to that point... advice in the article was that you should cancel the deal, unless of course they suddenly allow the original deal to go through after telling them you're walking away from it..

Nice link, that explains everything right there. Sounds like the law is on your side and you can get lawyer fees out of the deal too.

Lawyer up and tell them to fuck off

I went in, handed them the keys to the new car and said "original deal or no deal". They tried to haggle but I stuck to my guns and said "original deal or no deal". I got my car back and down payment. They knew they blew it. I had to say it about 15 times before they got it threw their thick skulls.

We went to a different dealer and got exactly what we was looking for and then some. We bought a 2009 Dodge Caliber SXT fully loaded. The Cash for Clunkers and Dodge's rebate we got a total of $8,000 in rebates. We ended up walking off the lot with a $20,000 car for $12,500. We traded in our 1999 Ford Explorer Sport we've owned for 7 years and it had 207,000 miles on it. It sounds like we did it just in time too. Seems they have ran out of money for the program as of today.

that is surprising that they didn't give you the original deal that was signed for rather than cancel it all, should have maybe had your lawyer handle it and demand the original deal or sue them for breach of contract

We was very pissed off and yes we could of got a lawyer and probably would of had the deal but I felt after them doing what they did I didn't want to deal with them at all plus more time and money which is the a waste in my opinion. They was just shady about the whole thing. It all worked out in the end with another dealer and we even got a better deal.
