Technically, yes.

They could then claim it back.

To be safe, you should start colleting the GST now, and hopefully you won't get back-charged for the previous income (although the CCRA could charge you for previous years if they feel like it)

After my conversation this morning, I'm totally at ease with the GST issue.

But hey, if you find a paysite willing to offer up the cash let me know and I might consider looking at them.

Good to know that you wouldn't pay those invoices.

Gammacash will pay the GST invoices you send them, so it seems not everyone finds it as outrageous as you do...

with more info now from a different thread I'd say that it isn't a big deal for GREAT orgional programs, but for average programs that you could find anywhere why deal Canadian when it requires more work?

You're right, for smaller webmasters that have less ressources, this will be more work.

However, I believe that if the webmasters is explained how to do it, it can proove to be very simple

Excellent. I am not too sure of the laws about the QST, but I heard that the HST (atlantic provinces only) should worry us more..

So, Gammacash for example, is located in Montreal. They are a Canadian sponsor, but the bank that they pay their affiliates from is US-based, in Deleware. You're telling me that, if I earn more than 30k from Gamma next year, that I should send them a bill for an extra $2100 (US) to cover MY GST??

Ya, I'm sure they'd get right on that. Whatever.


I think it should be up to the sponsor to handle matters of taxes and fees and things. All I'm doing is promoting them and their services, I'm not directly selling anything to the surfer. I take no payments from surfers at all, so where is there room to slap me with any GST bullshit?

First of all, it was already stated that Gamma will pay the GST, so no need to go further and speculate that "they would jump on that". They will pay it, and then claim it back. Can you understand this?

It is not the sponsor's responsability to make sure YOU comply with the tax laws. You provide a service to a company, YOU should charge GST on your services.

Maybe you should see a tax lawyer...

I can confirm that. Gamma does pay you the GST, and the QST if applicable. You simply have to fill an invoice they have created to make it easier for you, and they will send you the check. Of course, you have to send that ammount back to the government, so you gain nothing of it, and they get their tax back from the government too, so they do not lose anything either. It is stupid to make this money go through all of this, but this is how it works

Of course, to claim taxes from them, you have to provide your tax number. And you have to get one of those only if you make more than 35k CAN a year.

And you do not have to make more than 30k from Gamma alone. As soon as you have a tax number, you have to charge them, whatever the ammount you've earned with them.

It doesn't matter where the money comes from. You entered an agreement with a Canadian company (terms or service). They can pay you from anywhere they feel like, you are still in business with a canadian company.

You don't have to earn $30k from gamma alone. If your total income for that year is over $30k, or if you already have a GST number, you HAVE to charge GST to them.

The fact that you are promoting them means you are providing them with a service. It is the same thing as if you would sell shoes in a store. You don't have to own the store, or charge the customer yourself, you can just pitch the customer, and he'll pay the shoe store for his shoes. You are providing a service.
