You have to understand this when you do business with Brazzers, business is a game - they will do anything to win, even if it comes at someone else's loss. It sucks, I don't agree with it, but this is the route they chose to go with their business.

Corbin Fisher Plans Assault Over Piracy, Taps General Counsel

SAN DIEGO, Calif. ? Corbin Fisher on Wednesday said it would begin a vigilant campaign against content thieves and trademark violators.

COO Brian Dunlap said that with the industry beset with so much piracy Corbin Fisher plans ?to go after these criminals and welcome any company willing to join us in and contribute to these efforts."

Dunlap said that Corbin Fisher plans on teaming up with other content producers on legal efforts pursuing copyright violators and content thieves.

He also announced that the company has tapped attorney Marc J. Randazza as the company?s full-time general counsel. Randazza, a member of the First Amendment Lawyer's Association, has been a litigator for seven years and specializes in 1st Amendment law, intellectual property, trademark law and media law.

Corbin Fisher CEO Jason Gibson said Randazza's role ?will be to head up our antipiracy efforts and command the offensive we are preparing to take against those stealing our content.?

?[We?re planning to seek] out the infringers and their real identities, initiating legal action against them, pursuing judgements and firmly, loudly and forcefully sending the message that violating our intellectual property rights can and will result in major consequences for the violators,? Gibson said

Gibson noted that Corbin Fisher already has in place a sizable staff that has been logging infringing activity in preparation for future legal action.

I did about 6 minutes of googling, and I couldn't find any statements about depictions of rape in pornography being illegal in the united states. Could you please reference a case in which a rape porn producer has been locked up, or distribution of their film has been disrupted by the government?

the DMCA offers safe harbor for those that meet the definition - Pornhub and all tube sites in porn have no safe harbor because we as webmasters know that a majority of what's on pornhub and other tube sites is not uploaded by real surfers. That's all you have to prove to a judge or jury to knock them out of the box - but just going into a courtroom and saying 'it's common knowledge in the adult industry that these tube sites upload much of the infringing content themselves' isn't enough - you'll need to have some evidence or testimony from somebody the judge or jury will believe. that shouldn't be a huge stumbling block. hell, PornNewz dug up a gem in Google, one of the Brazzers clan posting to one of the Net's biggest movie pirates asking him to contact him suggesting to him that there's money to be made.

the reason they haven't been sued is that from big to small in this industry people are cheap - nobody wants to drop 100K to start a lawsuit when they can still spend 100K in this industry with a much quicker return than they'll get from a lawsuit. plus the aggravation that goes along with lawsuits.
