Hey Jay, good to see you back in action...Content flatlines in value as soon as you sell it non-exclusively. Sure you might get 10k in one day, but after that you ability to make money from that content again is almost nil.
More producers need to get that through their heads. Not that the tubes sites are paying for the videos they post anyways.
I understand that the value of content goes down once it is labeled as "non-exclusive", however, the practice until recently has been that the content was licensed for use in Members areas, with only a certain limited amount of content being authorized for traffic generating purposes (15-20 pix or 1-2 minutes of video).
A person/company that made their money back several times from the content off their own DVDs/sites, and then resells/licenses their content to other webmasters (for limited, paid member only use), should not then bargain basement their content to the rip-off tube/torrents sites, which in effect helps to legitimize their otherwise illegal operations, as well as devalues their content to other people whom only purchased the content since they understood that there was a level playing field, and the bulk of the content could only be displayed in designated Members areas.
If a 3rd party content producer thinks that they can sell content to pirate tube and torrents sites, and thus undermining the deals that they previously did with legit webmasters, and expect the status quo to prevail, then they are in for a rude awakening.
If they think there is any future in that business model, since legit purchasers of 3rd party content will quit buying from them, and once one of the pirates posts it on their site, all of the other would-be pirate clients will simply leech off of the original pirate site.
Yet another adult business model doomed to failure...

The DMCA already does that. Issue a complaint to the isp (usually the owner of the ip block), if the content is still online after several days, follow-up with the isp. If it remains online for more than a couple of weeks, contact your lawyer, and have them file suit against the ISP. However, if the user follows a counter-dmca notice, then they need to provide their address & contact information. At that point, the isp is declared irresponsible for the accessibility of the content, and you follow suit against the owner of the site. If the ISP doesn't get back to you after a couple of weeks, you have a case against the isp.This is an old argument. The bottom line is DMCA laws need to change to make site owners responsible for the stolen content on their site, no matter what, whether a user uploaded it or not. I doubt that will happen though. So although "illegal tubes" are unethical, they still have the law on their side and that's all they need to stay in business.
Remember, porn & mp3s aren't the only thing that the DMCA protects. If some dickhead felt like copy and pasting every word & page from a book onto a thread in this forum, that'd be a dmca violation too.

What they are doing is exploiting a legal loophole to rob this industry blind so they can line their pockets.
