Just had a chat with Paul (aka's Max)'s brother who said that his appeal has been pushed back to October so he has nothing but time on his hands right now... unfortunately he has no access to the internet or e-mail so it's good ol' fashioned pen and paper communication. Jim, the over riding factor was that they ordered the video from Max's site, now even though the order was actually fulfilled by another company they never left Max's site and the order did appear to have come from Max. Does he have grounds for appeal...yes probably but I never bouight the "they shipped the euro version by mistake" argument anyway because he openly advertised the sale of euro versions to US customers. So the argument isnt as strong as it appears on its face.

I do not believe anyone should be jailed for obscenity, specially since nobody can tell you what is obscene until after the fact. but that aint the reality.

If Max didn't know he was a target he is a lot fucking dumber than I think he is.

Thanks for the link! I hope you do drop him a note and show him some support. I can't imagine what it's like being locked up. In LA County now less.

I'm not a fan of the type of content he shoots but I do think the charges are lame because they went after the producer and everyone else in between him and the buyer got off scott free. He wasn't the one who went got the dvd and sent it directly to the customer, the retailer did. They should be aware of the do-not-ship-to states where its illegal to ship to. But what really bothered me was the the trial itself and the precedence it set. How do we protect ourselves as an industry if the retailer fucks up and the law goes after the producers. That just doesn't seem fair to me.
