Canada / gst questions

Would anyone have a list of adult sponsors from Canada? I need it for tax purposes and I can't find a list anywhere.

Do i need to charge gst to the Canadian sponsors who send checks and wire to my canadian compagny ?

If you check the Qwebec roster it might give you some help.. not everyone who attends / exhibits is from Canada but Quebec I believe is the adult hub up north.

Well I have been through this with GST. There is no consensus so they all like to waste time on the subject.

Essentially your commissions are made on sales. These sales are mostly made to users outside of Canada. Therefore no GST should be charged.

I try to avoid Canadian sponsors to lower my risk levels.

No, you don't need that for tax. You are paid on COMMISSIONS, so you can't charge GST on that

yes according to what i found to date , if your compagny or person make more than 30 000$ of business per year, you are required to charge GST ...

Even from commissions comming from a candian compagny who made the sales in the us.

I have never claimed GST in any way since everything I get paid is in US dollars and the currency is charged is US dollars. My servers are in the US so everything I host is in the US.

My accountant asked me about this and he gave the same answer as others have posted... there is NO clear cut answer. If collecting from Canadian companies yes you should collect GST but my account said the only real way to do that is have a list of the actual surfers you sent the sales from, were they Canadian?

So, I do not claim anything and tell the government all my money is US based sales (which is true).

the currency doesn't matter, I have sold higher value domains to Canadians in U.S. currency and charged gst on it

if the sponsor that is paying you is not located in Canada then your description sounds ok to me, as far as the affiliate is concerned, the sponsor is the one paying the commission

(although if a Canadian runs their own paysite and sell memberships to Canadian surfers then it would be hard to avoid that issue)

i'm not sure what the law is regarding GST for people who are affiliates of US or Canadian based programs. I think WiredGuy had a long drawn out legal fight with the CCRA over GST on affiliate commissions. he'd be the guy for you to talk to.

On the paysite owner side at one time GST was required to be paid on all your sales, the CCRA sued DawnsPlace a Canadian amateur paysite, the case went all the way to the Supreme Court of Canada and she lost. BUT thankfully the CCRA revised their rules and you're only required to pay GST on Canadian sales to paysites now.

If you make more than 35,000 a year then you may be required to file quarterly GST based on revenue, but if you make less than that, then it can jus be added as Commission Income on your personal tax return. This will increase the Taxable Income amount and may result in a balance owing.

Rabbits & brazzers gave me some good advices. It seem that i need to invoices all the canadians sponsors who sent me $$ since i,m paid for the "service" of reffering them clients

commissions + GST

big pain in the ass .. but i like to have my ass clean !

let us know what the auditor says (but I think generally they will err on the side of telling you that you better collect and pay everything possible)

nothing is more stressful than sitting there with all your paperwork in front of an auditor questioning all your figures though, it is best to plan ahead and do things right rather than panic after the fact while you are called in for an audit, and the gst people are really into the audit thing, way more than the regular income tax side of it, they get very upset easily if you don't submit gst that you are supposed to
