I would expect a legit honest operation to pay the invoice. It wasn't much money compared to what it should have been....and what it could turn into if not taken care of promptly.

Only a dishonest company would think it's ok to steal the work of producers and use it for their ad campaign without a license.

I have prepared a press release that will be sent to all of the adult news agencies first thing Monday morning just in case this issue is not resolved by then. I'll also be hitting up all the adult webmaster boards. I think it's extremely important that producers in our industry know that these guys think its ok to steal their work, use it for their advertising campaign and not license/pay for it. And also think it's important that affiliates see this type of behavior. If a company will steal from a producer, why wouldn't they steal from an affiliate?

We've gone after two individuals a few years back over copyright infringement (using our images on the front pages of their paysites) - and both times had our attorney send them a C&D letter along with a demand they pay us "compensation for potential loss of livelihood" due to the availability of our copyrighted images on their site(s).

Both of them settled (out of court) and sent us payments in the amount the lawyer had stipulated. One of them even called us at 4am EST (from Britain) after receiving the letter and shittin' in his panties.

As a side-note...you might want to check this out about the Suze Randall vs. Max Sheridan copyright settlement (May/2000). Your current issue is comparatively minor of course, but the legal precedents it set at the time are still relevant and food-for-thought.

This has not been resolved yet.

Someone pointed out to me this morning that the ad is still on their server. Now, common sense should tell you that if you got caught using stolen content, it would probably be a good idea to delete the content from your server. It's been almost a week since I discovered that they were using my content illegally and as of right now....it's still up on their server. I have a sickening feeling in my stomach because this is about to get real nasty. I really hate to take it to that level but these guys are giving me no other choice.

No legit company would blame this on a designer. They would just take responsibility for it and correct it as soon as possible.

When my crew and I are on location and one of my assistants accidentally scratches a piece of furniture or puts a small hole in a wall (which has happened)...I don't go to the homeowner and point the finger at my assistant. I (unlike these guys) take full responsibility for folks that work under my direction. I go the homeowner and do whatever it takes to make the guy happy. I simply do the right thing....

This kind of behavior separates the honest professional companies from the scammers, thieves and low lifes that plague our industry.

Oh, I 100% agree. I was just being slightly flippant, since that is the excuse/apology we see more often than not. :)

Welcome to my world Dean. It is an epidemic. I was in Vegas and saw my pics on BILLBOARDS and Taxi's. The best thing you can do is send everything to the (c) office when you first edit it. Then when you go after these assholes not only do you get a judgment of around $10k per image (per usage), but they will likely have to pay YOUR attorneys fees. The trick is to send them a C+D first by registered mail (better yet Fed-EX). Then when they ignore it you can go after them for WILLFUL infringement.

I don't ever let anyone fuck with my pics anymore. Neither should you or anyone making the effort to produce quality content.

I am not an attorney and the opinions I express are solely my own. Seek professional legal help etc etc....

HornyMatches is really bad. We've caught 100s of banners and galleries of theirs with our content. We've approached them over and over. A real pain in the ass.

We had a bunch of our content removed a few months ago. I believe there is still a bunch up. I need all my Twistys content removed from banners, ads, and galleries on hornymatches now and moving forward.
