Steph, what you might not realize is this: A real life amateur takes pics of her and her boyfriend doing POV BJ's... She sends it in to RealGFs and they get the licenses from both people in the pics and they match. Then they now have the 2257 docs they need. They have them sign releases and get a second ID... blah blah... After 2 years they license that content to someone else and give them copies of the 2257. Or they do this for 8 other sites. Now you start seeing it on newsgroups and what not as surfers repost it illegally... Then you get it from a newsgroup and ASSUME the content has never had any 2257 docs ever because you see 9 paysites with the same content and they "must" be doing what you are doing right? Just ripping content? No... So you get the DOJ involved. And they check everyone for docs... and then you are the only one fucked... and now you know why. |

Stephanie Hastert, you stated that you have the same content on your site, and
that you have neither 2257 documentation, nor copyright rights, so that pretty much disqualifies you from complaining about other people doing the same thing that you're doing, doesn't it? The only difference you noted was that you make your money from ads and don't try to keep kids from seeing your site, while the people you are complaining about limit access to adults only because they are pay sites. From a legal standpoint, that puts them in a better position than you. You also probably have higher traffic, given that your site is ad based, so you're committing the offences more. (Each time the image is displayed it's a copyright infringement and a violation of 2257, if 2257 isn't followed). Is it possible to have real amateur content and stay within 2257? Sure. The most obvious way is to do what all of the magazines do, require submissions to include a copy of their ID. One could also take a model who has never modeled before, do a regular shoot, pay them, and it would look amateur and they actually would be amateurs during the shoot, up until the time they got their first check in their hands. |
