AFF Still a Defendant in Epic Cash?s Suit Against Zango, Judge Rules.

Don't know if anyone saw this yet, but it won't help AFF to be fighting this as well.

AFF Still a Defendant in Epic Cash?s Suit Against Zango, Judge Rules.

Now if they lost this it will open the flood gates and I will be there are other companies sitting on the side lines waiting to slam dunk AFF with their claim. Pity is Epic can't get a split of the other claims after doing all the ground work.

Read it because there is a nice phrase there.

Quote:
Judge James C. Emerson overruled AdultFriendFinder in four of five causes of action of the demurrer. The only element of the motion sustained involved the conversion of Internet traffic, which the judge said wasn?t possible because traffic over the web isn?t tangible property.

AdultFriendFinder, a competitor of Epic Cash?s EpicCams.com website, is accused of having used Zango?s services to have ?diverted traffic away from Epic Cash sites and converted Epic Cash?s business to their benefit,? by ?taking advantage of plaintiff?s marketing efforts,?
and the judge ruled

seems like a pretty good ruling for AFF. What exactly were the other 4 claims.

Seriously why did you say that, if you did not know what the other 4 claims were about?

Did you not read the article?

Really? That is why the Epic Cash attorneys are celebrating the ruling. AFF wanted to be removed as co-defendant and lost the motion. Horrible news for AFF.

arcadia declared success everytime they lost major sticking points too.

Just because an attorney celebrates the ruling doesn't mean it good news.

lose conversion(in the context listed) and missppropriation, unjust enrichment and interference with prospective economic advantage become an order of magnitude harder to prove (not impossible but harder)

So AFF lost their motion to dismiss the case against them and they are the ones that won. Is it some reverse psychology thing they are trying to play on the judge?

do you realize how difficult it is to get a motion to dismiss, you basically have to prove that all of the complaints have no shot in hell of being correct.

i didn't say they won i said that the ruling that the did win, make is harder for epic cash to win this case.

You should not argue with him unless you want to make him look like he has a clue. Or you want to bump the thread.

BTW paul
still haven't hit me up do product placement and branding bugs properly.

was that all for show, in the hopes i would not take you up on the offer, or did you really want me to help you out.

Give me your contact info and I will make an offer. I will give you a split on all the product placement business you can get us.

Not sure what you mean by branding bugs, I may know it by another word. If you think there is big money to be made by getting your brand name or logo out in an area saturated by free loaders again I will give you money on this. You can upload films water marked with a logo and domain unique to you and I will give you up to 75% on all the sign ups off that domain. You know it works as you have told us so many time. So here's your chance to make money and prove to us what we are missing.

We could all end up supporting you.
