That depends on if you were charged for one fee or 62 of them. I have a friend who was charged for 22 OD fees just last month because of the very practice that this lawsuit mentions. 22x35.00 = $770.00 She is a single mother who's take home pay is well below 2k per month. It started with 2 or 3 fees that she was charged after her rent check was posted first as it was the higher dollar amount. Then a couple smaller things posted which were actually purchased before the rent check was even written. She saw the pending charges would overdraw her account when they posted so she went to the bank and made a small deposit to cover the pending items. The deposit posted right away and showed her balance as positive. A couple days later the other charges posted, one of them being .28 for a gold fish for her child. These charges were followed by more OD fees of $35.00 each. She thought her account had a positive balance based on their online banking. Even though her account was positive before and after the charges posted, they hit her with the fees because it was OD just from the PENDING charges. If you make a deposit before something posts to your account, you should not be billed any fees for it. ![]() Being billed $35.00 for a .28 fish is just fucking stupid. So...Long story shortened a bit....The first few fees were not budgeted for nor expected in any way. When they hit, it overdrew her account which then made her new pending charges show as OD's. And so the cycle continued. The bank offered her a courtesy adjustment of $35.00. They also returned her $280.00 car payment as NSF and billed her for that too...Plus the fee the lender charged her for the returned check. Kinda funny that I read about this case now as I went to the bank with her last Monday and while this was being discussed, I told the branch manager that I felt this type of thing could easily warrant a class action suit. I'll be forwarding this info to her as well as printing it out and taking a copy to the branch manager today. I've worked in the banking industry. I know first hand that they intentionally fuck people over whenever they can. 35 Million is nothing compared to how much they have stolen with their fucked up practices. |

yep i was charged over $400 last month b/c there system glitched screwed my balance up and they refused to fix it.

right after I graduated from highschool I had a 80 dollar McDonalds burger due to this very thing...
I learned quick to not trust banks and keep it well stocked with funds ![]()
