If I'm not mistaken I believe that if it is filmed in the US she has to have a US/state issued ID.

That is what I thought.

But my reading of:

just says photo ID without reference to jurisdiction or issuer.

Its not state mandated or federally mandated by 2257, but if you or your company wants to 1099 a person with no state ID or ties to the US and its tax system you wont be able to expense it or write it off. Thats why a lot of shooters and companies dont shoot people with no US ID's. And others dont do it because most people dont.(this business is full of followers). lol

But what you can do is write the check to the agent, 1099 the agent and the agent pays the taxes that the model would pay and you and or your company gets the write off.

there is a tax treaty between Canada and the U.S. so that individuals do not get taxed twice on the same income in both countries, a Canadian resident must claim the income that they earn in the U.S. on their Canadian income tax return and pay income taxes on it in Canada. If they are in the U.S. longer than 6 months in a year they are classified as a U.S. resident and are required to file and pay taxes in the U.S.. The U.S. will likely still require returns to be filed even though the u.s. income is also being claimed on Canadian returns.

It gets pretty complicated so an accountant experienced in Canada/U.S. is a must.

Might better look at the 2257 amendments that went into effect in December. Taken straight from the DOJ website at: usdoj.gov/criminal/optf/links/2257-compliance-guide.html

Each producer must check a picture identification card issued by a United States or State government entity for a performer who is an American citizen, whether the production occurs in the United States or abroad. The identification card must contain the performer's date of birth. A producer abroad may rely on foreign government identification cards for foreign performers, but must maintain a copy of that identification. A producer may not rely on a foreign identification card for a foreign citizen when production occurs in the United States, but must check a United States identification card in that circumstance.
