There are two different banned substances lists compiled by USOC, WADA and the IOC. There is 'in competition', which are drug tests given during a sport's season and 'out of competition', which are unannounced, random tests given in the off season.

Since athletes frequently undergo surgery and therapy in the off season the out of competition banned substances list is far more lenient. For example, pot isn't on it.

So Phelps will not face sanctions for his actions.
