It's a terrible situation, since it appears on the surface that the BART cop over-reacted.
That still is no excuse, or a license, for idiots to start smashing in windows of stores and cars of people in their own neighborhood whom had nothing to do with the situation.
News is coming out that Oscar Grant (the 22 year old guy killed) was no angel either, even though some people are already trying to paint him as some kind of martyr:
Grant, who had a 4-year-old daughter, lived in Hayward. He was remembered by family members at a news conference on Sunday as a loving father, a hard worker and a sports enthusiast.
Grant also had a criminal record; according to the California Department of Corrections and Rehabilitation, Grant served several months in state prison in 2007 and 2008. The Department of Corrections didn't disclose the offenses for which Grant was sentenced.
Records at the main Alameda County Courthouse in Oakland indicate that Grant had 12 separate cases between April 12, 2004, and May 8, 2008. But the records for all of those cases are at the Hayward Hall of Justice and weren't immediately available.
It's terrible for anyone to be killed wrongfully, or by accident, but something tells me that if it wasn't the BART cop that OG would have possibly come to a similar fate based upon his past...

I agree with you 110%.
It's horrible that anyone got shot by the police, accidental or motivated by hatred of race or what not. But that does not give groups of people the right to smash windows of local business that had nothing to do with any of this.
I'm still pretty pissed about Prop 8, but you don't see me trying to set cars on fire.

I thought I read he said he thought it was his stun gun. Not sure how similar the two guns are to one another as I've never held a stun gun. The video is real bad though. The guy is cuffed and basically on his stomach I believe with a cop on his shoulders. The shooter stands up, pulls out his gun and fires.
I hope it was an accident. Not only for the reputation of police officers but for the sake of the good cops who are out there. Unfortunately, the situation was handled poorly. The cops proceeded to go around and illegally confiscate cell phones from bystanders to try and destroy evidence.
No excuse for violent protests though. However, I understand their frustration. These cops should all have been terminated. Cops routinely get off with slaps on the wrists for their deadly actions.

the whole thing is tragic, but this part of the situation should have everyone in the country up in arms...... are we that close to living in a totalitarian state??
all of those cops that confiscated cell phones should be brought to task for it, including the department itself

There are lots of rumors circling, many of which will ultimately be proven to be false.
That is exactly why calmer heads should prevail.
The TV station that first claimed to show proof on video that Grant's hands were cuffed, has since retracted that claim.
As for the cops "illegally" confiscating cameras, they are simply collecting evidence. Now if they actually do destroy what is captured on the cameras, that would be illegal.
I am not naive, since I recognize that there are some bad cops out there, however, I also feel that the system has to be allowed to run it's course.
The community has every right to mourn and protest, however they do not have the right to become a lawless mob, and do property damage to people totally unassociated with the situation.
I should also note, that the individuals whom seemed to be doing the most vandalism appeared to be hoodlums without a cause, or the wannabe revolutionaries from the same outside agitator groups that regularly sprout up to exploit any protest situation in the Bay Area, in order to recruit and further agitate the crowd into more violent action.

Apparently there is a big loophole that falls under "exigent circumstances" which permits police to round up potential evidence at a crime scene.
The DOJ and courts apparently provide a good deal of latitude to law enforcement when it comes to search and seizure of electronic data (cell phones, computers, e-mail, etc).
Gross negligence and involuntary manslaughter sounds right to me. Very sad
"I thought it was my taser", pretty much covers it. And if someone thinks it's just a lie, then it's a stupid ass lie since it's admitting gross negligence. That officer surely knows it's all over for them one way or the other.
Anyway, most of the time I just sit around the office waiting for the weekend. Don't get me wrong, I love the money the job pays. But my real passion lies in kicking people's fucking heads in at football.

I believe that the stun guns that most police agencies are using have a grip almost exactly like the ones on the fire arms. So you can bet that it could have been a mistake. BUT
You have to ask yourself what police agency would allow an officer to have on his belt from front to back a Fire arm, and then a stun gun. The stun gun gets in the way of drawing the fire arm, and in the event of extreme pressure, the officer could easily draw the stun gun instead..
I know that the Holster that most police agencies use is a Safari3 or model 3 or something like that. It has three safeties that have to be defeated to get the gun out. 1. Top snap. 2 thumb snap, and 3, the rear strap. So unless the Stun gun is carried the same way, the guy is a total idiot.
