Prostitution Illegal, Pornography Legal?

This comes out of ignorance and stupidity.. and the inability to figure it out on my own.

Why is prostitution illegal and pronography not?

people are having sex in either case. Whats the deal? Is it because there is a camera involved?

(So if I go hunt up a hooker and take a camera with me, is that legal?)

For some reason there is a difference.

First of all, not all pornography has people having sex. Also, even hardcore stuff isn't always people who wouldn't have sex anyhow. Sure, most of it is, just pointing out that there are a lot of kinds of porn out there. Why would pics of my girlfriend gobbling my knob be illegal, thinking along these lines? ;)

Still, I have wondered about the whole pay-for-sex angle. I think I can see why it doesn't apply, though. First of all, it is rarely the sexual partner who is paying the model, and the primary purpose in either case isn't generally sexual gratification. It's producing the images.

The main reason is a lot simpler, though. Freedom of speech. Pornography is a creative work-- occasionally even actual art, and certainly an act of communication and a created work. As such, it is protected by the First Ammendment, and related principles/laws.

Here's a question I think may be better... If a brothel provided a tape of the experience, and called themselves a studio, could they get outside of prostitution laws?

I guess I just don't really understand. Sex is Sex.. they are both being paid for.

One is just to be used over and over on film or internet.

I get the "art" part of it more, but I guess I'm just too niave and stuck on old ways to really see the difference. If people really want sex that bad they are gonna get it.. legal or not. Oh well.

Also, one legal definition of prostitution is "people having sex for money for the pleasure of someone present." So, if I hire two girls to have sex while I masturbate, that is prostitution. If I hire them to have sex for the camera, it is not prostution. That should also explain why the brothels would still be engaging in prostitution as long as the person paying for the experience being taped is participating in it. Except, if he's creating the tape for resale (he'd better have a company in operation, though, and not just be "building up material"!). This is how the point-of-view guys get away with it.

I'm not an attorney, but this is the gist of what I understand from hearing people in the industry and various attorneys.

Adult movies and films are protected by free speach, and are not considered pandering, but it was in the 70's until it became protected speech. It is a form of art, expression.

Prostitution is considered a crime and therefore has no protection.

I'm wrong. In some states, some forms of sex are illegal. Orals illegal in a lot of states in the usa...

It is only legal in one county in Nevada unless somethings changed recently.

I was talking about American law. I had no idea that it wa legal in Canada. Is it legal throughout Canada? Or are there local laws about it?

Easy, Fletch. I came from a backwater town in Maryland. EVERYTHING is politically correct.

And I've never needed a hooker so I've never bothered knowing the laws on hookers.

All I remember about prositution in law class is that 80 % of all women arrested are arrested on charges of prostitution. Selling AND buying.

But that was from a while ago.. so those stats probably aren't correct anymore.

Just because you live in a place doesn't mean you know all the rules.

Well, right nwo I wouldn't mind hiring a prostitue. I wouldn't use him for sex, but as an escort downtown. One thing I hate is going downtown after dark.. especially to st. catherines by myself. Ugh. For some reason I attract males when I'm on st catherine streets.

I think some debate on this subject came up once when Luke Ford was being sued by a porn star for writing about her being a prostitute.

I believe it came down to something like a porn star fucks a guy for money on film, and a prostitute fucks a guy for money but not on film. Huge difference? Not really.

But this is in reference to a porn star, not just a nude model or solo jerker on film. I won't name the porn star hehe, but I bet someone here probably knows.

If it bothers you that much that i don't know much about the industry but want to learn, then I'll go find another place to waste my time. And anyway, they didn't teach that crap where I went to school, and my christian mother wasn't about to tell me about it *anyway*.

Oh hell nevermind. I'm going out to St. Catherines to try to have a little fun. I've wasted enough of my time trying to learn about this industry today. Maybe monday I'll give it another go.

All the model contracts I have looked at (not a great number, I admit) all seem to have a clause that says something like "I (the model) understand that I am not being paid to have sex, I am having sex for my own enjoyment. I am only being paid to allow the photographer to take pictures of it." and some even specify that even though the photographer may introduce two people and suggest that it would be nice for them to happen to have sex in front of his/her camera, thus allowing him to take pictures which he will then pay them for the rights to, he is nonetheless not in any way paying them *to have sex*

Legal fiction, but whatever works....
