Of Interest to Non-USA Webmasters

From the latest AVN Online magazine:

'Geelan, president, chief executive officer, and legal counsel for YNOT Network LP, warned foreign Webmasters not to become too complacent simply because most of the day?s discussion centered on US issues. "While I know of no cases yet where a foreign Webmaster was brought to trial in the US," he said, "since the Internet is accessible globally, recent US Supreme Court decisions support the notion that a non-US-based Webmaster may still be hauled into court in the US for violating US laws, assuming that the US government has an extradition treaty in place with the country in which the Webmaster lives - or if they can catch the Webmaster while he is visiting the US - and the US government has the resources and desire to pursue prosecuting the Webmaster."'

pretty shitty. just like saying a dutch webmaster, hosted in the netherlands, can be 'dragged into the usa for trial'.

on second thought, it isn't pretty shitty. by the christ.

it's just completely fucking stupid.

Pretty scary.
Flying over for the Internext show, you'd end up in in the slammer instead, pending a trial...

I doubt they'd extradite you from the country you have a citizenship in.

I guess a lot may depend upon how much porn is loved in your home country. In most countries, I would think, the government wouldn't want to go on the record as pro-porn, or appearing to be.

Yes, also would depend what kind of offense we are talking.

i like that for incidents of child porn and such - go after those bastards. But we have to wonder where the line will be drawn - as laws change from town to town in the USA and even aol, yahoo and ebay arn't truly compliant to the wishes of the bible belt.

If the US Courts and the Executive seriously wish to exercise the laws of the US and extend their jurisdiction into other countries then this is cause for great concern.

Recently the US (Courts and Executive) have seemed to take the line that they are able to prosecute foriegn nationals for acts which occur off US soil. It does not seem to matter if the person hasn't broken any laws in their own country. This is obviously not right and precisely the kind of attitude that led others to target the USA. When the US is able to exercise political, legal and economic control over foriegn states then you have really got a situation that many people feared would develop if anyone actually "won" the cold war - the trouble is the propoganda of the western alliances always focused on the evil that would take place should the USSR gain world dominance , never was a scenario painted that modelled or predicted the outcome of UK/USA dominance.

The USA will remain a target of disaffected groups as long as it holds this misconception that it rules the world. Unfortunately countries like our own Australia seem to continually tow the US line - and the US is not always right.

[please dont misconstrue this post as supportive of illegal actions upon innocent people - it is just a cause/effect scenario which has developed post cold war]

The article stated that large groups of webmasters might be tried for "conspiracy to spread obscenity". You'd get tried for laws from ANOTHER country that has jack shit to say about you in the first place, talking some conspiracy crap. God shit like that pisses me the FUCK off!! WHat a load of shit.

Its like the fucking French trying to haul in a guy who sells Nazi memorabilia on his website. Never fucking happen.

I would love to see the US try and extradite some German kid for running a poop and pee site. What a fucking joke.

And lawyers sell fear.

Lawyers in this industry have been preaching about the crackdown from day one. Always just around the corner.

Fuck I hate lawyers.

Exactly. No longer can you count on being safe if you only comply with laws in your country. If Saudi Arabia asked John Ashhahahahaha to deport you so you could have some body part hacked off for offending their laws, what do you think he would do?

Yeah like the US is going to fucking extrdite me for hosting porn sites in Canada and processing with an EU company. What gives the US the fucking right to go "Hey your on the internet and your websites break the rules so we are going to have you bought here and arrested!!" No fucking chance of that in my oppion.

That sounds like a fucking headache for them if they even tried. They could get you if you visited the US I gues though. But I think they will be more concerned with the easy targets, all you US webmasters best of luck in the next couple of years, the shit is going to fly and this dictator govt has about 5 times the funds of the democrats so there going to win the elections easy.

It is scary.

I collect my checks in the US every two weeks or so.

On the other hand, I'm not breaking the law so I shouldn't have any problems.

However, these religious nuts connected to the Republican party and in particular to Ash... You never know what they'll come up next.

Like "If you by porn you're supporting terrorism" or some crazy shit like that.

"According to Walters, access by minors to material "deemed harmful" to them is a major concern for the DOJ, and law enforcement is likely to use that as a starting point for prosecution."

TGPs will be an easy target if the DOJ goes through with this.
