Off topic personal loan question

I am going to make this short and sweet. I spent around $15-20k to help my boss move myself and 3 others, including him to California from NY. I have all the reciepts and verbal agreements but no written contract. I even have the other two employess as witnesses to our arrangement., which was I pay upfront and when money rolls in I get reimbursed. My problem is no money is here and I have other opportunities. I don't want to walk away from the situation if it jepordises my pay back chances.

I know I fucked up. I kick my own ass every time I get a chance. Does anyone have any legal knowledge on what kind of recourse I have if any at all.

The best bet for you right now is to get a Personal Note guarantee from him PERSONALLY not his corporation.

Also have him start making payments even 200 or 500 a week but start getting out what you can ASAP.

But you should really try to get something on paper from him personally.

Let them know that you want the money back. Give them a date to comply by (in writing). If they do not comply by that date, consult with an attorney, and get his/her advice. Then threaten to sue (in writing). Send these via registered mail, certified return receipt, signature required. If they still do not comply, take them to court.

From what I understand... they will be liable for court costs, and attorney fees, if you win. So, add that to your damages.

Before actually sueing them, make sure you let them know that there was a verbal agreement, which is binding... it's just harder to prove. With the wittnesses on your side, it will be a breeze, unless the defendant can disprove, or discredit your wittnesses.

best thing to do is go to an adult webmaster board where people don't take a single fuckin' thing seriously and ask them. Thier advice has always worked for me.... (except once, and it cost me 12K)

LOLOL..so true bro, going to gfy for advice is about as useful as asking a monkey....

But hey EscortBiz gave some good advice. If you grt the fuck face to make a few payments even if they are small, then if and when you have to take him to court, the fact that he made a few payments will show the Judge that he in fact acknowledges that he does owe you money. Also if you can get him to personally sign a promissory note then thats even better.

Sounds like a serious mistake. Here's what I would do;

1. Ask him if he is serious about paying you back. If he says yes, get a personal note that states the amount, date and nature of the loan. If he balks, you know what is real and proceed with the notarized, certified letters and court bullshit. The witnesses and receipts should be good for you and will probably convince a judge that you are in the right. You might still have trouble collecting even if you get a judgment.

2. Never, ever loan big bucks without writing, collateral or a means to collect. Sounds like an expensive lesson. Good luck.

Dude, a bell didn't ring when your boss couldn't afford to move even himself let alone the rest of the staff??? unfortunatly, if you get fucked you deserve it.. basic common sense.. Three rules of life.

1) do not loan money to family (unless maybe if its life or death. but if so don't ever expect it back

2) Don't loan money to friends unless the same as above apply;s

3) don't loan money to your poor ass boss regardless of the fucking reason. Even if he's breathing his last breath on the ventilitator.

Investors loan money all the time.

However, a more appropriate statement would be:
Never money that you can't afford to lose. If you have to ask "How much?".... You can't afford it.

So, if someone has $5 Million in the bank, maybe $10k isn't a big deal, and could be written off as a loss, or a necessary business expense, if receipts are kept for the venture.

Although, if all you had was $10,005.00 and you loaned out $10k... You could have probably red flagged this one and said "no".

If your boss can't afford to do the move, what makes you think that he will be able to pay you back, unless you knew of how he would pay you back prior to giving him the dough?

Or maybe, if you don't really NEED the money, you could "give" it to him... Have him SIGN a contract with you, with what you want in return for NOT sueing him. Go for something of equal value. Maybe share in his company, or possibly something else. Whatever it is... get back what is yours. Whether you sue him, or you come to alternate payment methods.
