This guy wanted to swap some traffic with our site...we let him check out our members area...and then never heard from him again. Today I check his site and my entire members section is on his site...labled as his own! I then notice that he has stolen some of lightspeeds stuff as well.

What is the best way to handle this?

Expose him to the webmaster community though, regardless of what the outcome is.

It's not like he's got a great site...and I assume most of the stuff on it is stolen. One of my members actually suggested that I check him out saying that he liked the raw aspect of the site.

The memebers section has a link to a supposed trip taken to the Missouri River...and it's actually Tayler and Raimi from Lightspeed...which I doubt he purchased the rights to.

I'm thinking about making a trip to Nebraska and paying this guy a visit.

CC it to his host and to his billing company.
This usually works with me.

I've had excellent luck with Yahoo getting them to take down some of those thieving groups. .. They remove the whole group.
MSN on the other hand - asks the group leader nicely to remove the offending photos and that's the end of it.

The problem when contacting some one like a CC processor, host, sponsor is that you have to establish they are your pictures. You own the rights to them and that you are serious about suing them. APIC do not have this problem.

When they get a DMCA from this well known PITBULL, with a bad attitude, about stolen content they tend to sit up and take notice.

A bad reputation can work in certain cases

can you actually get anything if someone is using your content in their members area, other than making them remove it?

say they had 15 of your exclusive pics that you shot. i know of a few sites that have my content but never wasted the time. if i could get something out of it like taking over the domain maybe it would be worth looking into more.

Unless you have a lot of money and the shots are "Copyrighted" with the authorities you are going to waste a lot of time and money.

The pirates usually do not have the money, that is why they are stealing. But if you can tie in a big sponsor with a lot of bucks you might have a chance. Some shooters earn good money by suing these people.

They use to cry they did not know and there is nothing they could do. But now once they have been served legal notice they are liable, this was how Adult Check fell down in the Perfect 10 case. They just wiped their hands and said there was nothing they coud do. Fourtunately for the industry, Perfect 10 had an option, sue them.

Damm IBILL can hardly handle their own problems let alone dealing with someone elses.

I can see contacting his hosting company which is how I always deal with this type of problem but I have never contacted CC processors, yet. Hosting companies have a legal obligation to review sites that may have content of a questionable nature.

Maybe I should start contacting CC processors.

Would they shut him down just on the word of another webmaster?

Seems like opening a can of worms here, what about people that are just pissed off at guys like you and me, they could just start calling our processors and saying we have stolen content.

Hosting companies seem to have staff members to look into these issues do CC processors.

I cannot believe that you think that this was good for the industry. This is the most moronic statement I have heard in my live. This has huge indications. take all your credit cards, and all your friend's cards, make 100 accounts at his site. this way he'll get so happy hes making more than his usual 3 sales a week, then charge them all back. he'll have fees to pay, will end up closing his shitty site, and you wont have to spend a dime.

Legally informing the host as well as the processors with the required proof of ownership, IE: a copy of the licensing deal you made with a model, opens them up to be sued as co-defendants upon their not following thru with terminating the pirates business dealings.

Under the US Laws, they are financially gaining as well as the thief. So are open to being held as co-defendants. AND if found guilty... Also a guilty verdict sets all legal fees that you incurred sueing them right in THEIR laps.
