A question,would this be spam

I keep all email addys of all members past and present for our site. We are producing a video next month and my question is.If I write a former member of the site to inform them that this video is availible for purchase. Would that be spam ? and is there a way to get around it without pissing them off.

Hi Tony, I do mass opt in email marketing. A good question to ask in answering your question is What did you tell them when collecting the email? Do you have a privacy policy? Is this covered by the policy? How was the email collected? Was there a confirmation email that spells out your privacy policy?

lol so its spam I get the idea. What I dont understand and it baffles me is why its alright to snail mail junk mail.I get two to three pieces of junk mail everyday Where junk mail on the net is spam and its considered a crime. That baffles me.
