Daughter took her dad to court over grounding, and WON... unbelievable judge's ruling

TORONTO ? The father of a feisty 12-year-old girl says he?s going to appeal a decision by Quebec?s Superior Court that ruled last week he had no right to discipline his daughter by barring her from a school trip.

The Globe and Mail reports that the man first banned his daughter from going online after she posted photos of herself on a dating site.

Then the Grade 6 student, whose parents are divorced, allegedly had a row with her stepmother, after which her father said she could not go on a three-day school trip that would mark her class? graduation from elementary school.

The girl, who?s been staying with her biological mother since May, took the matter to court and Madame Justice Suzanne Tessier ruled on Friday in her favour.

The father?s lawyer, Kim Beaudoin, says his client, who?s stunned by the decision, feels like he?s lost his daughter and wants to appeal so no other parents will go through what he has.

Trying to avoid having grounded teenagers rushing to the nearest courthouse, lawyers for both sides insist the judge?s decision applies only to this girl?s unusual circumstances.

That's pretty much it. I heard about this while listening to the news on the radio earlier today, and that's basically how the news announcer saw it as well. The guy is trying to be a dad, didn't like the site his daughter was posting her pics on, and meted out some standard punishment.

Not only did the little brat take him to court, but the court sided with her.

Unless there's more to the story I haven't heard yet, I'm floored.

The courts shouldn't even be entertaining stupid cases like this.
She's crying because she was grounded and the courts spend tax payers money on choosing sides???

It's crap like this that make me laugh at people who say "Parents don't discipline their children any more, that's why they're so bad these days"

The bit they're mostly leaving out: her mother.

A 12 year old doesn't just arrange a lawyer and go to court. The mother has to have been involved there. Sounds to me like the mother is trying to use her daughter to get to her ex-husband for some unresolved issues.

If you read carefully, you'll see that it is a news story out of Toronto, and that it mentions the ruling was made in a Quebec court.

Nowhere do I see anything said about it happening in Toronto.

Absolutely ridiculous that it was even brought to court, let alone not thrown out and ruled in the daughter's favour.

And she definitely should have been punished for registering for the dating site, by being banned from going online.

However if there's anything to be said for the daugther's side, even though it shouldn't have even been allowed to be a court case - her Dad should not have disallowed her from going on the trip. No matter how rotten she was being, disabling her from something that is going to be a monumental memory for the rest of her life that all of her CURRENT PEERS are going to be experience is just fucking stupid/bad parenting.

Funny thing to me is that just last week we did the exact same thing with our daughter. She's only nine, but even in three years time I don't see her having the mindset ALONE to take us to court over something like that.

Yeah, I disagree. If the ONLY monumental memories that child is going to experience is that one particular trip, perhaps. But we've given our child MANY more memories than a school field trip. Punishing your child by taking away something like that is hardly bad parenting. NOT taking that away from your child when it deserves to be is bad parenting.

Okay if it was a graduation thing then yes, I probably would cave on that, but honestly I feel THAT is bad parenting. I'm looking at it from the perspective that OUR kids get a field trip at the end of EVERY year, so this was one she just had to miss and make no mistake, it was still a difficult decision.

I'm inclined to side with you on this argument. I say it's on the kid as to whether he/she goes on a field trip, graduation trip or not.
Act up like a little spoiled brat - no trip, period.
Behave, and listen when she's told told - off she goes on her trip.

lol, oh man, we gave her NUMEROUS chances because quite frankly, we didn't WANT to take it away. But she blew it. As a parent though, as difficult as it is, sometimes it has to be done. I guarantee to anyone that hasn't done it, WE felt WAY worse than she did. It's the same with spanking. I can count on one hand the number of times we spanked our kids, but it was a terrible feeling.

But in 10 years, I'm betting (admittedly with a lot of hope thrown in there) that my kids will be better off than those kids that have never had to deal with the repercussions of their actions.

Surprisingly similar to that of the UK, considering were, you know, a British colony and all. :D

I'm sorry but no 12 yr old girl should be putting photos of herself on a dating site. The dad was correct to remedy that and forbid it, and was right to administer punishment for it. Like I said, barring any new information I think the judge is out to lunch on this one.
