Most situations like this don't get resolved until the legal threat comes via a written document sporting an actual attorney's letterhead. Once that written threat is received, such disputes often are resolved pretty quickly.... I wouldn't be too surprised if that turns out to be the case here.

Of course, it's always possible that the court would find that there's no merit to Xbiz's claim -- but given the similarity of the names/marks, and the fact that they operate in the same market sector, and more than a few in the industry have expressed confusion about whether Claire/xxxbiztv are associated with Xbiz, I think a judge would be inclined to let the action proceed.

So the same would apply if xxxbixtv have no money, who would end up paying the legal fees. I am asking this because I do not know how the US law deal with things like this and kinda find it strange why somebody would want it to go this far.

I think D-Money said it first... hand over the domain and work out some type of "marketing" deal... i.e., work at the next XBiz event. That would work out for everyone I'm sure and it would benefit Claire greatly in the long run.

I dunno the whole story here, bit if the beef is just the domain xxxbiztv.com and not the company name, dont see anything really "wrong" sort of speak.

There's a huge difference between X and XXX and tv is added.. I guess if xxxbiztv.com is media company would be a problem, again not sure of full story here so I just shutup and watch

Never liked the name xbiz anyhow, so I'll root for the underdog seeing when I started in this biz I sold Helmy toys and never got a dime from them :)

Oh good grief... if GFY "makes" or "breaks" you than McDonald's is a much better fit anyway.

This industry is one of the most forgiving industries in existence... the things that happen just months later after a scam is "revealed" is hilarious. GFY is simply a tool... it is not the end-all.
