Wow... I guess you put the ball in their court, and they took it out of bounds. Best of luck with the upcoming proceedings.

There's enough dance floor in this business to avoid stepping on toes.

Most situations like this don't get resolved until the legal threat comes via a written document sporting an actual attorney's letterhead. Once that written threat is received, such disputes often are resolved pretty quickly.... I wouldn't be too surprised if that turns out to be the case here. Of course, it's always possible that the court would find that there's no merit to Xbiz's claim -- but given the similarity of the names/marks, and the fact that they operate in the same market sector, and more than a few in the industry have expressed confusion about whether Claire/xxxbiztv are associated with Xbiz, I think a judge would be inclined to let the action proceed. |
I honestly though that XXXBizTV.com was XBiz. My thinking was that XBiz's magazine, which I recieve every month, was starting to do live streaming off events and shows related to adults.
It took me a couple of times to figure out the XXXBizTV.com was not at all associated with XBiz. She should have she the named...oh well, she is gonna learn the hard way. |

I still don't see how people confuse the two names... If Xbiz launched a TV site don't you think it would just be called XbizTV?
XXX = triple X an appropriate term in adult It's like if there was xcash and xxxcash or something (actually there is triplexcash and xxxcash isn't there?) - it's not the same name. Oh well, Americans are lawsuit-happy what can I say. I guess if XBiz actually feels XXXBizTV is hurting their business, they are doing what they have to. I just don't see that happening, XBiz is a HUGE brand and besides a few GFY clowns no one is confusing the two companies :2 cents: |
I think xbiz would have serious problems winning this in Court. Just because both parties work in the same area of business etc doesnt mean its a closed case, are we all not working in the "xxx" business or "xxx biz" or whatever else we wish to call it??

Sure will make an interesting case I guess... X versus XXX
|
I think people got her handle on the board confused and not really the site directly. The relation of the two sparked confusion and not the site.
She doesn't appear to be trying to profit from the xbiz name or claim she is xbiz. The name, site design, colors and logo are different. The only possible complaint is the related business, however they are different and not within direct competition of each other. At that, the site and what it is doing - is a prefect match for the name. This is a far reach with piles and piles of brown noses for everyone. |
Does this mean Claire isn't invited to the Xbiz mixer tonight?
|
i remember when steve cohen was suing everyone who owned *sex.com
and either he was winning, or forcing them to concede.. i dont recall which.. but he was on a rampage |

We don't know what Xbiz offered though. Claire has a reputation, be it good or bad on this forum and others I'm sure, and if she were to change her name she's losing something.
What was offered in return? My feelings are they did offer her something lucrative, but it either it wasn't enough, or she thinks playing hardball with Xbiz is somehow a good idea. If she really wants to hold on to the name forever, she has no clue about business whatsoever. Less than 0. This is an opportunity. Now another question: Is Xbiz reporting on this? :D |

I agree, it's not a wise decision on her part to fight against a company like XBiz, who is someone you want to have a good relationship with. Not to mention I'd wager their resources are a lto larger than Claire's (or her company's in this case). I'm just mroe shocked than anything else at how many people seem to be confused, I guess I give people more credit in regards to common sense than they deserve :1orglaugh I also don't think this is a threat to XBiz at all, but I guess they do see it as something they are addressing. I just think the whole thing is overblown. |

maybe xbiz wants the new traffic generated by this startup and are hoping to bully xxxbiz into giving them the name and traffic. maybe that's why they waited until now :2 cents:

watch out everyone you'll be labled haters for pointing out the obvious. tons of people busted her out for lying and all sorts of stuff and most didn't call her any names, but yet everyone who fought the titties and pussy was labeled haters. suck it morons. its blatant infringement. she started a media company. the idiocy amazes me some times here. words of advice, don't endorse peoples over having a couple drinks and a snog with them at shows. her game stunk from the beginning. now go off to cybernet show and make friends with her to come back and back her up once again.

So the same would apply if xxxbixtv have no money, who would end up paying the legal fees. I am asking this because I do not know how the US law deal with things like this and kinda find it strange why somebody would want it to go this far. |
you should just hire her....and indeed start streaming live from events all over:)
|
You should change your name to a symbol
http://paulawhyman.sb2.authorsguild....nce_symbol.jpg "the girl formerly known as xxxbizclair.tv" |
I think D-Money said it first... hand over the domain and work out some type of "marketing" deal... i.e., work at the next XBiz event. That would work out for everyone I'm sure and it would benefit Claire greatly in the long run.

It is also a necessity if one wants to have a business to preserve in the first place. |

I dunno the whole story here, bit if the beef is just the domain xxxbiztv.com and not the company name, dont see anything really "wrong" sort of speak.
There's a huge difference between X and XXX and tv is added.. I guess if xxxbiztv.com is media company would be a problem, again not sure of full story here so I just shutup and watch Never liked the name xbiz anyhow, so I'll root for the underdog seeing when I started in this biz I sold Helmy toys and never got a dime from them :) |
