Jesus. Almost got DUI tonight

Just happened 20 min ago. Had dinner with a few friends, drank a few glasses of wine, nice dinner. Driving home, I glanced in my rearview and saw flashing red and blue lights. Pulled over, a shaky early 20s cop walked up and asked me for license and registration and walked back to his car for 20 min. another cop walks up, asks me whether I had anything to drink, I said “no”, then asked me to get out of the car to do a few tests. This is the first time this has ever happened to me, im freaking out. He is asking me to follow my eyes to this light. I straight up tell him that the cop cars, flashlights, etc are freaking me out and if he wants to know if im drunk, to give me a blood test and be through with it, as if he is asking me for some sort of test, all this other shit will throw off the results. He does the light test, then asks me to walk a line and back, then hold my foot off the ground for 30 seconds and count them outloud (I did this like a champ, very proud, those bastards looked surprised), then he tells me to get back in the car.

Im sitting there, gauging what they are going to come back with. 10 min later they came back with a speeding ticket. The cop said, “well, I smelled alcohol, but when I did the tests, I didn’t think you were drunk so I forgot about it”

In phx its easy to get paranoid about these things

one thing people don't know, well, don't think about is, you can actually be written for driving while impaired even if you are under .08 bac. in california, the penalty for that is just as bad as getting the full blown dwi. minimum 3 month alcohol program, loss of license for a month, at the discretion of the judge. you don't even have to blow for that. sucks, but they can do it. whether it sticks is your burden to prove to the judge. who really wants to go through that. be careful out there.

I got pulled over once. He asked me if I had been drinking. I pointed to my GF and said, "You are smelling her, she just called me to come get her."

She was pretty out of it and he told me, "Great to have guys like you on this planet man!"

I was on my way back to the bar to do some more drinking.

Don't most States take refusing a blood test as a fail? I remember that being a question when I was going for my learner's permit in PA.

there is a reason the limit is .08 rather than .00, you could have a glass or 2 of wine over the course of a long dinner and get up afterwards and be fine. The cop gave me sobriety tests and felt comfortable enough to let me continue to drive. if you cant drive after drinking *any* alcohol, then 95% of the people leaving bars/restaurants would qualify for a dui and cops should, in effect, pick them off like flies that way, but that’s not how it works.

Its not as black and white as if you drank at any point before driving = bad. Its an issue of whether you have the ability to operate a vehicle safely.

So what's your point? He passed the field sobriety tests with flying colours, which are there for the officer to decide whether or not your motor skills are impaired. If the officer thought for a second his motor skills were impaired, out would have came the breathalyzer.

He clearly had no evidence that the breathalyzer was needed.

My point is pretty simple, the original poster was nervous and knew he was driving after drinking, lie about it, and NOT KNOW if he passed the test. Nervous enough to post about the incident, and breathe a sigh of relief on a message board, sharing it.

While this should be a wake up call for others, some are seeing it as a get out of jail card.

How many times have you gotten behind the wheel of a car after drinking? I'm curious, the vehemence in your posts lead me to this question.

i dont trust cops, especially a rookie who may have a chip on his shoulder and i was in a situation where only bad can come to me and no good and i was on full guard. i have *many* friends with dui, some multiple, but this was the first time in 10+ years of being of bar age where i was being given a field sobriety test and i *had* drank that night

real quick, at one point in my life i was in the back of a cop car, because of a party being too loud and the cops having to come back after a first warning. in the police report the cop wrote something false in the police report just to make his case. couldnt believe somebody would do something like that but it tainted me for life

plus im jewish and your "one isn't paranoid unless there's a reason" comment makes me smirk

but yes, i just saw the thread title the message is a stronger one that i wanted to send and this is a very sensitive subject. i guess i dont get into a lot of situations with police and when it happens, i just expect the worse.

i didnt want to send the message that i was driving drunk, as that wasnt the case

Okay, but you lied about your drinking. They thought as much, and gave you a test anyway. I don't trust Cops either, but I do trust technology, especially the microphones and cameras that now record everything they do.

Most people I know get nervous around police.

As for lying to the police, I certainly know enough from past experiences that you don't offer information to police that will cause them to want to question you further, unless you are just looking for a way to pass the time. If I get pulled over for speeding I'm sure as not going to tell the cop I just drank a beer at lunch time.

As for your last question, I will have 2 beers with a meal every single time I go to a restaurant. So probably more times than I can remember.

I guess that's where we differ. Last time I was stopped, about a decade or so ago, I was asked if I drank, which I answered truthfully, yes wine with dinner. There wasn't enough cause for the officer to test me, no smell, and it wasn't erratic driving, just ran a stop sign making a turn.

Let's face it, 2 beers with a meal depending on your body size, what you ate, etc wouldnt' even register or impair you at all. I'm just pulling from the orginal poster's own words that he was worried enough, and the cop though enough cause to test him.

Well a few months ago my friend's 3 year old was killed by a drunk driver.

Not taking into effect, the dinner, which would slow the absorption into your blood, I came up with this:

3 drinks at 170 lbs = .066 BAC
less 2 hours time passed since your first drink (minus .015 per hour)

which leaves you with .036 BAC, which is not even enough to get a 12 hour suspension where I live.

Impaired is of course .08 in most areas.

What I can never understand is why do the police over in the USA make you do a sobriety test, is this to humilate you or something cause over here in the UK they just ask you to blow into a tester if they think you have been drinking ...the mind boggles

I ve always wondered the same thing, been tested in the UK and in Australia both times they use a breathalyser not some crappy test that you could still do whilst over the limit.
I not a big fan of cops either but as long as your not a twat to them and your polite they're ok.

Plus our drink drive limits are really low over here ! less than a pint or a couple of glasses will put you over, here.

Yeah you are right there

I got pulled over on my motorcycle for a bald tyre years ago and allthough I had already booked it in for the next day to have it replaced I was stupid for riding the bike like that, the cop that pulled me was behind me when I stoped at the traffic lights, He was on a bike as well and he went into his panniers to get the tyre tread depth tester but he couldent find it, he told me to get it sorted asap and just let me go . But he was polite and so was I and I think this made the difference between me not getting a fine because you could see the tyre was bald.
